1881 07 Nov - Daily News - Sheffield - On Saturday morning early, Police-constable James, of the West Riding constab
-ulary, had a desperate fight with a burglar at Wincobank Hall, near Sheffield, the residents of Mrs Raw-
-son. Looking across the lawn on the officer saw a man stealing towards the drawing-room window, and
thinking a gang of burglars were at work, the constable rose Mr (William.) Hulley, a farmer, who lives
near. The constable and his companion returned to the hall quickly and found the burglar forcing an
entrance to the drawing-room window. The officer rushed at the man, who struck him a heavy blow with
a sharp steel jemmy, which cut completely through the constable's nose and chin. Although he bled
fearfully the officer grappled the burglar, and a frightful struggle took place, but ultimately with assistance
the burglar was arrested. (also in Freeman's Journal and Daily Commercial Advertiser Nov 10, Leeds
Mercury, Manchester Times Nov 12)

1881 07 Nov - The Manchester Guardian: DESPERATE ENCOUNTER WITH A BURGLAR NEAR SHEFFIELD. -
Shortly before three o’clock on Saturday morning an attempted burglary at Wincobank Hall, the
residence of Mrs. Rawson. was frustrated by the courageous and judicious conduct of a constable
belonging to the West Riding Constabulary. This officer, Police Constable James, was patrolling his
beat, when his attention was attracted by a slight noise as if a pane of glass was being cracked in one of
the windows. Looking across the lawn in front of the house, he saw a very tall man going stealthily
towards the drawing room window. Thinking that gang of burglars were at work, James quietly left the
grounds and proceeded to the house of Mr. William Hulley, farmer, who resides a few hundred yards
away. That officer called up Mr. Hulley, who returned with him to the hall. Looking through the shrubbery
the constable saw that a man was forcing his way through the drawing room window. James at once
rushed at the burglar, but was met by a terrific blow with a heavy sharp steel jemmy, which cut
completely through his nose from the top down to the bottom of his chin. The constable, however, closed
with the ruffian and stuck to him manfully. After a desperate struggle the officer with the assistance of Mr.
Hulley managed to capture the burglar, on whoso person were found a powerful steel jemmy, dark
lantern, and a bayonet-shaped dagger. He had also a large gimlet, with which it was found he had
bored several holes through the window shutter to enable him to unfasten the iron bars inside. Before
doing this however, he had carefully made holes through the two large panes of plate glass and undone
the window fastenings. The man was conveyed to the Ecclesfield Police Station. He is a powerful fellow,
at least six feet high. He refused to give his name or furnish any account of himself. There is little doubt
that he is one of a gang of burglars who have been very busy in the Barnsley district recently, as well as
at Tinsley -. The constable is dangerously wounded.

1881 08 Nov - Sheffield and Rotherham Independent - THE WINCOBANK BURGLARY. FURTHER PARTICULARS.
The clever and brave capture of a burglar, at Wincobank Hall, early on Saturday morning, by police-
Constable James, of the West Riding Constabulary, has come in for general praise in Sheffield and the
neighbourhood. The constable at present lies in bed at his house, Lower Wincobank, greatly weakened
from the loss of blood which he sustained, and suffering severe pains in his head. There can be no
doubt that had the blow with the "jemmy," by the burglar, been inflicted but an inch or two higher on
James's face the result would have been fatal. It is a matter of some surprise that after being so much
injured, he managed to walk with his prisoner to Ecclesfield Police Station about three miles distant.
The assistance which the man Hulley gave was timely, and but for it the burglar might have effected his
escape and the constable been more seriously injured.
It was about half-past two in the morning when James, standing at the school-gates, about 60 yards
from Wincobank Hall, heard sounds of glass breaking in the direction of the hall. Suspecting that
someone was endeavouring to effect an entrance he quietly approached the garden in front of the
drawing-room. He then climbed over the wall, and, to prevent his being seen or heard, crawled on his
hands and knees behind some shrubs, a few yards from the house. He heard a noise proceeding from
near the drawing room windows, and peering closely through the darkness, he observed the figure of
man at the side window. He watched a second or two, and was convinced that it was “the burglar a-
burgling,” and upon the man walking cautiously walking to the front of the house he believed that he had
a companion.
Knowing that he would not be a match for two burglars, he stealthily returned to Higher Wincobank for
assistance, and went to the house of Mr. Hulley, who is about 50 years of age, and who is a maker of
forks and a keeper of cows. To awaken him in a quiet manner, he threw pebbles at the bedroom window,
and in a short time he was joined by Hulley, who, being told what he was wanted for, armed himself with
a poker. They crept behind some shrubs, and saw the man still working at the window. While watching,
they saw him go towards the front, look up and down the road, and then return to his task. The constable
drew his staff, and, suspecting that the burglar would be possessed of a firearm, it was arranged that they
should rush upon him, and suddenly overpower him. Immediately they moved, however, he heard
them, and turned round, and with the jemmy that he had been applying to the window, struck the
constable, who was nearest, a fearful blow on the nose, cutting it completely open, and causing the blood
the stream out. James hit the man’s right arm with his staff, and caused him to drop the jemmy, Hulley
striking him so severely somewhere about the head or shoulders that the poker was bent. The constable
and the burglar closed with each other, and fell to the ground; James was underneath, but succeeded in
getting above his opponent, who then cried “I’ll give up.” Hulley held him down while the handcuffs were
put upon him, and the three then proceeded to the house of the gardener James Kirke, at the hall. Kirke
was aroused, and supplied water to clean the faces of both the constable and the burglar, for the latter’s
during the struggle had been covered in blood , which dropped from the injured nose of James.
Afterwards, the prisoner was marched to Ecclesfield, Hulley and Kirke’s son walking on either side of him,
and the constable, with his drawn staff, at the rear. During the journey, the man said, with regard to his
attempt to break into the hall, that he had “been put on to it” with another man, but this other person was
unwell, and he accordingly went alone. He said he himself came from Newcastle, but that he had tramp-
-ed all over the country, and had recently lodged at a house in Barnsley. He gave the name of James
Thompson, and added that he as about 38 years of age. He looks that age, and is a big, muscular man -
taller even than the constable, who is about six feet in height.
The Ecclesfield police station was reached at four o’clock, and when the sergeant residing there had seen
that the prisoner was safely locked up, he took James to the house of Dr. Symes, where his injured face
was attended to. A piece of the cartilage had to be removed, and when plasters had been applied, the
constable returned to Wincobank, suffering great pain. He went to bed, and has since remained in it, and
will not, it is believed, be able to appear against Thompson for a day or two.
The inmates of the hall were unaware, until seven o’clock on Saturday morning, of the attempt made to
break into it, not having heard the slightest noise. An inspection of the window that had been tampered
with showed that very soon Thompson would have effected an entrance, but he could not have done so
without alarming the inmates. Attached to the bars at the rear of the shutters of every window are bells,
and immediately the shutter was moved two of these would have rung. When he was interrupted, he was
boring through the shutter with a gimlet, his object being to make a small hole through which to put his
hand and remove the bar fastener. The bolts at the top and bottom of the window were drawn, and the
“catch” removed, the glass having been broken with some sharp instrument to enable him to get at them.
Even had he entered, he could not have stolen any silver plate, for when the hall was last broken into,
some 26 years ago, the plate was removed. In various parts of the house, too, we believe, are appli-
-ances, one of which if touched, would warn the inmates of the presence of an intruder.
The prisoner will, in all probability, be brought up at the West Riding Police Court to-day, and remanded.

1881 11 Nov - Sheffield and Rotherham Independent - DESPERATE FIGHT WITH A BURGLAR AT WINCOBANK HALL
- (incl.) At the West Riding Court, on Tuesday, before Mr W. P Milner, James Thompson, 35, who stated
he belongs to Newcastle, was charged with having attempted to commit a burglary at Wincobank Hall,
and also with cutting and wounding Police-constable James, with intent to do him grievous bodily harm.
The prisoner had a very dejected face, and bore evident traces of the severe encounter between himself
and his captor. Superintendent Gill said Police-constable James was unable to attend, asked that the
prisoner might be remanded until Tuesday next, when he believed several other cases of burglary
would be preferred against him. The Bench complied.

1881 16 Nov - Sheffield and Rotherham Independent - THE ATTEMPTED BURGLARY AT WINCOBANK.
COMMITTAL OF THE PRISONER. - The man James Thompson, in custody charged with attempting to
commit a burglary at the premises of Mrs Mary Ann Rawson, Wincobank Hall, early on the morning of
November 5th, was brought up on remand at the West Riding Police-court yesterday, before T. Jessop,
Esq., W.P. Milner. Esq., and T. Jeffcock, Esq., for further examination. There was a second charge
against the prisoner of unlawfully cutting Police-constable James (who, it will be remembered, was
seriously injured in effecting the capture of the prisoner) with Intent to inflict grievous bodily harm. There
was a large attendance of the public in court.
The prisoner is a tall, powerfully-built man, apparently about 35 years of age dressed decently, and not
at all ill-looking. The officer, James, who apprehended the prisoner, is also a tall, well set-up young
man, but in personal strength he is undoubtedly inferior to the prisoner.
Superintendent Gill, of the West Riding constabulary, conducted the case for the prosecution. The
prisoner was undefended. Police-constable Walter James said he was one of the West Riding constab-
-ulary stationed at Wincobank, and about half-past Two o’clock on the morning of Saturday, November
5th, he was on duty near Wincobank Hall, near High Wincobank, where Mrs. Mary Ann Rawson and her
sister resided. At that time he heard a noise as though some one was breaking glass near the hall. He
was then patrolling the road, and upon hearing the noise he crept quietly through the shrubbery on to
the lawn. When he got within about 12 yards of the hall He saw the prisoner standing near the drawing-
room window, and he remained watching him for about ten minutes. The prisoner walked from the
drawing-room to the front of the house, passing within seven or eight yards of him, and then returning
to the window.
The witness went back to the house of Mr. Wm. Hulley, farmer, High Wincobank, and called him up. He
and Mr. Hulley then returned to the hall and found the prisoner still at the window, making a noise; but
he could not tell what the man was doing. The witness and Mr. Hulley were concealed behind a flower
bed for a time, and then the witness approached him. The prisoner turned towards him and dealt him a
blow with a “jemmy” (produced), which cut open his nose and chin. He believed both injuries were
inflicted with one blow. He struck at the man with his staff, seized hold of him, and a struggle ensued, in
which they both fell to the ground. The prisoner got on the top of him, but he rolled over and gained the
ascendancy, and Mr. Hulley, coming to his assistance helped to hold the prisoner down until he could
handcuff him.
He then called up James Kirk, the gardener, and having bathed his wounds, searched the prisoner.
Upon him he found a bottle containing whisky, a box of matches, pipe, tobacco pouch, and a dark
lantern. After removing the prisoner to Ecclesfield, accompanied by Hulley and Kirk, he locked him up.
The prisoner gave his name as James Thompson, but declined to say where he came from. He said ” I
should not like you to know where I came from.” The witness went to Dr. Simes at Ecclesfield, where
his injuries were attended to, and he was still under treatment. Subsequently he returned to Wincobank Hall, accompanied by Sergeant Willmott, and he then receiv-
-ed from Mr. James Kirk, a “jemmy” and gimblet. On examining the drawing-room window, where the
prisoner had been standing, he saw there were three holes made through the glass near each of the
three fasteners, which were undone. The window was of French construction, and the part that was
opened was about 5ft high. One side of the widow was ajar. Inside the windows there were shutters
almost close to the glass. Twelve holes had been bored through the shutters, a panel of which was
Produced in court. The gimlet fitted the holes in the panel. Another implement of triangular shape was
pressed between the window shutters and the frame work of the window, apparently with the object of
keeping them firm whilst boring operations were being carried on. The prisoner asked no questions.
Mr. William Hulley, farmer, High Wincobank, said that about half-past two on the morning in question he
was called up by the officer James, and accompanied him to Wincobank Hall. He thought it a necess-
-ary precaution to take with him a kitchen poker. He saw a man standing by the hall window, and heard
a noise of cutting wood.
They watched him for a short time, and then the witness and the officer rushed upon him together. The
prisoner struck the officer, who returned the blow, and then witness gave the prisoner a blow with the
poker. The constable and the prisoner fell together upon the ground, and between them they managed
to secure him. The night was cloudy. He accompanied James to Kirk’s house, and there noticed that he
was bleeding from the nose.
Mr. James Kirk, gardener to Mrs. Rawson, said he resided in a house adjoining the hall, and was called
out of bed early on the morning of the 5th November by Mr. Hulley and Police-constable James. The
latter’s face was covered in blood. After Hulley, James, and the prisoner left his house, the witness
remained until daybreak. He then found near the drawing-room window a “jemmy,” upon which there
appeared a little blood, and a gimblet. The latter was lying on the lawn. The two squares of glass in the
window were broken in three places, and the right-hand half of the window was open. In the putty there
were marks of some sharp instrument which had been used to break the glass.
Agnes Jardine, a domestic servant at Wincobank Hall, said on the evening of the 4th inst. She fastened
the drawing-room window on the inside. The bolts in the window frame were fastened, and she further
bolted the shutters ands placed an iron bar across them. On the following morning she noticed that the
glass of the window was broken.
Mr. Robert Sime, surgeon, Ecclesfield, said that on the morning of November 5th, the constable came
to his surgery about five o’clock, suffering from a wound about an inch and three-quarters long, begin-
-ning at the bridge of the nose and extending on the left side, going down to the cartilage, and at one
point piercing it. There was a scratch on the chin in a direct line with the other and more serious wound.
He had to stitch up the principal wound, and the officer was now progressing favourably. The “jemmy”
produced was a likely instrument to cause the injuries. The prisoner, who did not question any of the
witnesses, and had nothing to say in answer to the charges, was formerly committed for trial at the
assizes.
Superintendent Gill said another charge of burglary would be preferred against the prisoner for entering
the house of Mr. Burley, Birthwaite House, near Barnsley, and stealing therefrom on October 6th six
silver teaspoons, a silk handkerchief, and a bottle of sherry. He asked the magistrates to remand the
prisoner and fix a time for the hearing of the case. The Bench decided to take the case at noon to-day
(Wednesday.) (Note: 1881 census RG 11/4616 f72 - Mary Ann Rawson, Agnes Jardine; f72 rev -

1881 07 Dec - Sheffield and Rotherham Independent - THE BURGLARY AT WINCOBANK.
PRESENTATION TO POLICE-CONSTABLE JAMES AND MR. WM. HULLEY. The inhabitants of Winco -
-bank last night testified their appreciation of the courageous conduct of Police-constable James and Mr.
Wm. Hulley in a manner which will long be remembered by them. In the early part of last month the
policeman, while on duty, discovered a man attempting to burglariously enter Wincobank Hall. James
Thomson, who has since been committed to take his trial at the Assizes, is a tall, strongly-built man, and
the officer wisely decided to call assistance in order to make the apprehension of his man sure. It being
midnight, he went to the residence of Mr. Wm. Hulley, called him up, and the two proceeded to the Hall,
where, after a very severe struggle, in which the officer was struck in the face with a steel jemmy by
Thomson, the burglar was apprehended.
The residents of the locality decide to recognise the bravery displayed by the policeman and Mr. Hulley,
and the Rev. J. Julian, vicar of Wincobank, took the matter up, and with the assistance of several other
gentlemen, collected a sufficient amount to enable them to present each of the men who had risked
their lives in the discharge of their duty with a handsome testimonial. The permission of the Chief
Constable of the West Riding police force having been obtained, the committee who had the matter in
hand, decided to present Police-constable James with a handsome silver chronometer, and Mr. Hulley
with a complete set of plated table spoons, dessert spoons, tea spoons, large and small forks, sugar
tongs, and salt spoons. It was also arranged to give a complementary concert in recognition of the
services rendered, and to present the article during the evening.
Police-constable James, in returning thanks, expressed his pleasure in knowing that there was also a
present for Mr. Hulley. He was sure that he deserved one, because had it not been for him Thomson
might have got away; at all events there would have been a terrible struggle for it. Mr. Hulley had risked
his life in rendering service to his country. (Applause.) He again returned thanks, and expressed his
determination always to do his duty to the upmost of his ability.
The Rev. J. Julian then presented Mr. Hulley with the articles named above, and stated they were of
equal value as the watch which he had just presented to the police officer. He referred to the fact that Mr
Hulley, although not aware that he was liable to imprisonment if he refused to assist the police, readily
complied with the request of Police-constable James. He then presented the articles to Mr. Hulley
amidst loud applause.
Mr. W. Hulley briefly returned thanks, after which the Rev. J. Julian stated that there was a sum of money
in hand, which would be equally divided between the persons who had just received the presentations.
The second part of the programme was then proceeded with.

1881 10 Dec - Sheffield Daily Telegraph - THE WINCOBANK BURGLARY
A complimentary concert in recognition of the bravery of Police-constable James and Mr. Hulley, at
Wincobank Hall, on the 5th November last, was held at the National Schools, Wincobank, on Tuesday.
The circumstances which have called forth the concert must be fresh in the memory of our readers, but
we may say that on the night of the 5th November last Police constable James was on duty near Winco-
-bank Hall, when he heard someone near a window of the building . Having ascertained that a burglar
was attempting to enter the hall, James at once called Mr. Hulley, who lives hard by, out of bed, and then
returned to the spot where the man had been. The constable went quietly towards the burglar, who see-
-ing some one about to capture him, struck James upon the face with a jemmy, inflicting a deep cut on
his nose. James then closed with him, and a tough struggle ensued. Mr. Hulley, who had taken with
him a stout poker, dealt the robber such a blow as to keep him quiet and enabled James to place upon
him the handcuffs. The man was then brought before the magistrates, who committed him to trial. For
the courage displayed by Constable James he was at once awarded the merit and good conduct
badges by the Chief Constable of the West Riding. (Captain Russell.)
In addition to these honours the people of Wincobank determined to substantially recognise the efforts of
such worthy neighbours as Constable James and Mr. Hulley. Accordingly, the Rev. J. Julian, with the
assistance of a small committee, collected subscriptions with which to purchase presents. To constable
James was given a handsome silver chronometer , bearing the following inscription:- Presented to
Police-constable James in recognition of his meritorious conduct at Wincobank Hall on November 5,
1881. Mr. Hulley received a full set of table spoons, dessert spoons, tea spoons, large and small forks,
sugar tongs, and salt spoons, made of the best Sheffield plate. The attendance at the concert was very
large, and influential, and the programme was an excellent one.
The Rev. J. JULIAN, in the course of the evening, applauded Constable James’ bravery and recognised
his courage. Being associated with the testimonial, it was an extreme pleasure to him to say that he had
been supported on every side; and he would now call upon Constable James to come forward to receive
in his name, and in the name of the inhabitants of Wincobank and a few friends outside, a handsome
watch as a token of their appreciation and regard for him and his courage. (Applause.)
Mr. JULIAN said: Police-constable James, it affords me extreme pleasure to present you with this watch,
upon which is subscribed “Presented to Police-constable James in recognition of his meritorious conduct
at Wincobank Hall on November 5, 1881.” I hope and trust that the courage you then displayed will still
mark your conduct in the future, and that when your children get up to be men and women they may be
able to point to this watch and that badge on your arm and say “ Our father was a man.” (Loud applause.)
Mr. JULIAN said his task had not yet been completed. Has had another very pleasing duty to perform. Mr.
Hulley then stepped on to the platform amid much cheering, and Mr. JULIAN said: Mr. Hulley is a family
man, and if he has health and strength to find beef and mutton as long as these articles can be used, Mrs.
Hulley and all the little Hulleys need not be afraid. (Laughter.) I have very great pleasure in offering you
this present. I have been told by those who have known you from childhood that you have always borne
a character for bravery which characterised you on the occasion of this late encounter, and which has
won for you the esteem of those around you. I trust that you will ever remember when you look at these
things that you did your duty, and your neighbours thanked you for it. (Applause.)
Mr. HULLEY said he never expected to receive anything when he was called up. He had not time to think
about this evening. (Laughter.) Constable James scarcely gave him time to get dressed - he had to finish
his toilet on the way. (Loud laughter.) Then when he got there the constable said, “Look out for yourself; he
may have a revolver about him” (Renewed laughter.) He had not time to look to himself; he was looking
for his man. As soon he got near enough he gave him what satisfied him - (laughter) - and he was now
well satisfied with his present, for which he thanked them kindly. (Applause.)
Mr. JULIAN said ther was a balance over which would be equally divide between the two gentlemen.
(Applause.) (also in the Sheffield Independent 10 Dec 1881.)

NOTE ON JOSEPH HULLEY OF SHEFFIELD.
In no family records was it anywhere noted that Richard, the settler, had a brother in Sheffield. This fact
was only disclosed in August 1911 when Thomas Benjamin Hulley of the Edward John group visited
England. After an attempted contact failed, contact was made through a firm at Holmfirth, Yorkshire. In
the firm’s letter a local William Hulley disclosed that he was the grandson of Joseph Hulley, who had
lived at Kimberwell Hill Top in the Parish of Rotherham, Sheffield. When this William wrote he was 81
years of age and had retired from his trade of cutler and was farming at Unthank Farm Holmsfield. (PAF
ref York01-085)
He mentioned in his letter that Joseph had a brother Richard who had gone to South Africa in 1816 or
1817. He further wrote that in 1854 Richard visited them in Sheffield and Richard asked William to
accompany him back to South Africa, but William declined.
Joseph was a cutler by trade and so was William and his brother Thomas. All three turned out cutlery on
their own accounts and sold to the eminent cutlers Joseph Rogers & Son, Sheffield. There is silence
about any sisters or other brothers.

removed to the Public Hospital, and had since been a patient.
The room in which he was working was close to one end of the boiler, and in the same room with him
were his brother and an apprentice boy. The former was injured, but the latter escaped. A few minutes
before the explosion he (witness) asked Porter, the engine driver, how the boiler was going; and he
replied that the water was still running out. He then told Porter that he had better be careful or he would
blow them up. Porter said he hoped he should not, but if he did he could not help it. He asked Porter, a
few days before, how the boiler was, and he then replied that it was not quite safe. He had not comp-
-lained to Mr Hides of the state of the boiler, nor was he aware that any of the other men had.
A week before the explosion occurred a man named Foster left his work at the place on account of the
boiler, and said he was not going to be blown up. A week before the explosion the boiler was examined
by Mr Holt, engineer, but he did not hear that gentleman's opinion of it. By the Jury: He believed that the
general impression among men was that the boiler was dangerous. In answer to Mr Clegg, he said about
50 men were employed on the premises.

1895 25 Feb - Sheffield Evening Telegraph - SHEFFIELD CITY POLICE - THIS DAY -
Before the Stipendiary Magistrate - HUSNBAND AND WIFE IN TROUBLE.
George Knutton, ex-warehouseman, and Lucy Knutton, warehouse hand, man and wife, were charged,
the woman with stealing, and the man with receiving a number of forks , the property of George Henry
Hulley, who carried on business at 17, Cambridge Street, as a cutlery manufacturer, under the style of
Hulley and Co.
Mr. A. Muir Wilson prosecuted, and stated that the female defendant has for long time been employed
by the prosecutor in his warehouse. Considerable quantities of forks have been missed, but it was not
until Thursday night last that the police were able to make an arrest. Detective Marr was watching. He
saw Mrs. Knutton come from the works of the prosecutor with a parcel, which she handed to her hus-
-band. The detective followed him, and eventually stopping him took the parcel from him and found that it
contained forks which had been stolen from Mr. Hulley’s place. Both prisoners were arrested. Mr Wilson
added that the thefts had been carried out for at last twelve months.
There were other charges against the husband - for receiving goods stolen from Mr, Hulley’s works on the
17th and 18th January 1894, and on the 23rd January, 1895. It was discovered that these articles after
being stolen were pawned. The male defendant, in defence, said he had been out of work for a long
time, and whatever his wife had done, she had done it to keep the home together. Mr Wilson said with
regard to the female defendant Mr. Hulley believed she had acted under the dictation of her husband,
and he therefore hoped the Stipendiary Magistrate would deal very leniently with her. As to the man it
was thought that the justice of the case would not be met by a fine. The male defendant was sentenced to
six week’s hard labour, and Mrs. Knutton was bound over to be of good behaviour for six months, her
father being surety.

1876 14 Nov - Sheffield and Rotherham Independent - AN UNFOUNDED CHARGE - Wm. Hulley,
Rotherham, was charged with stealing a florin, the property of George Adams
Oldfield, landlord of the Dusty Miller, Westgate, Rotherham. Mr F. Parker-Rhodes
defended. From the evidence given by Emily Burley, a servant, and Mrs Lucy
Oldfield, the landlady, it appeared that on the 9th instant, the former put a 2s. piece
into a cupboard. Soon afterwards, the defendant was seen near the cupboard, and
subsequently the coin was missing. A policeman was sent for, but before the officer
arrived the defendant gave the florin to Mrs. Oldfield, whilst paying for some beer, it
having been in his possession over an hour. Police-constable Berry arrested the
defendant, who said he took the florin, but only in fun. For the defence, Benjamin
Tingle, moulder, Ickles, and Nathan Taylor, labourer, Rotherham, were called, and
stated that it had been done as joke, and to tease the landlady, Mrs. Oldfield. The
defendant was discharged.

1861 Jun qtr - son Tom born at Wortley RD: Hulley Tom Wortley 9c 186 (GRO).

1861 20 Nov - Sheffield and Rotherham Independent - Magisterial Proceedings - ILL-USING A
DRUNKEN MAN AT ECCLESFIELD. Three men, residing at Ecclesfield, named
Respectively Joseph Ulley, George Green, and George Hyves, were charged with
assaulting Daniel Doe, of the same place. Mr. Broadbent was for the complainant,
and Mr. Chambers for the defendants.
Mr. Broadbent said the complainant charged the defendants with committing one of
the most extraordinary and cruel assaults that had been brought before the Court.
On the 23rd of October, the complainant was in a public-house on Ecclesfield
Common, and about half-past ten in the morning the defendants went into the house.
They told him he must go with them, and then carried him out of the house, put him
into a wheelbarrow into the road, tying his hands and legs to the vehicle, and letting
his head hang over. They wheeled him through the streets of Ecclesfield, until they
reached a pond, in which they repeatedly “ducked” him. They then wheeled him to a
public-house, and there committed such a barbarous act as the Bench could hardly
believe to have been done in this country. They actually roasted him before the fire
to such an extent that he was severely burned, after which they poured drink over him.
The poor fellow was then replaced upon the wheelbarrow and taken to other public-
houses, where he was subjected to similar ill-treatment. In wheeling the man along
the streets, they took special care to dash over every stone heap they met with, in
order to jolt him as severely as possible. Having first whitened his face with chalk,
then blackened it with soot, they put the man in a cart, and sent him home in a state
bordering on insensibility.
The man was so ill-used he had to call the services of Mr. Hawthorne, surgeon. He
was absent from work a week in consequence of the ill-treatment, and was able to do
very little when he resumed. It would, no doubt, be pleaded in extenuation of the
conduct of the defendants that the complainant was drinking, instead of attending to
his work, thus throwing other men idle, and that it was a custom at Ecclesfield, as it
used to be at Sheffield, to fetch men to their work in a wheelbarrow under such
circumstances. The fact, however, was, that he was having a glass because he had
very little to do, and on one was kept idle by his doing so. Had the men merely
wheeled him to the works in the ordinary way, there would have not been so much
ground for the complaint; but understanding the barbarous treatment to which they
subjected the man, he hoped the bench would commit the defendants to trial.
Doe was called, and confirmed the statement of Mr. Broadbent. After describing the
ill-treatment to which he was subjected, he said he was so dis-figured on reaching
home, that his wife did not know him. She thought he was a chimney sweep. He had
suffered very severely from the ill-usage, saying he could neither lie down, sit, stand,
nor move without pain. They jolted him so that he thought they would have broken his
limbs. The medical man ordered “fermentations” for his injuries.
In reply to Mr. Chambers, Doe admitted that Ulley had, some time before, been
fetched from a public-house in a wheelbarrow; he did not take any active part in what
was done, and said Ulley was not ill-used as he (Doe) was. Lads pulled the
wheelbarrow in which he (Doe) was placed by means of ropes.
After some confirmatory evidence had been given, Mr. Chambers submitted that the
offence was one of a very slight character, being in fact nothing more than a rough
sort of “lark”, perpetrated in accordance with a custom which was “more honoured in
the breach than in the observance.” The plaintiff went off drinking, throwing three or
four men dependent on him idle, and a rude kind of justice was inflicted upon him, as
it had been previously upon Ulley. No doubt it was wrong, but he was sure that the
Bench would take a lenient view of it, even if defendants were the men. He however
had witnesses to prove that they took very little part in the matter. Mr. Chambers was
proceeding to call witnesses, when Mr. Bayley said an assault in law had no doubt
been committed, but it took very much of the character of a lark. They should not,
therefore inflict any heavy punishments. Mr. Broadbent urged that such barbarous
customs were out of place now, and should be stopped, and the Bench cautioned the
defendants against repeating such conduct. After some conversation the defendants
were ordered to pay amongst them £2, including costs.
