1882 18 Mar - Lancaster Gazette - COUNTY COURT - a sitting of this Court was held on Monday last, before T.H. Ingham, Esq., judge. The only cases of any importance were the two following: - SMITH v. MAUDSLEY and LAMB v. HARGREAVES. Thomas Myles Lamb and Co., spirit merchants, Lancaster, claimed £14. 7s. from Amelia Hannah Hargreaves, administrix of Thos. Hargreaves, innkeeper, deceased, for goods sold and delivered. A counter claim for £50 for money over paid was set up. Mr. Tilly appeared for the plaintiffs, and the defendant was represented by Mr. Neill, of Bradford. Receipts were produced for monies paid by the deceased to plaintiff’s late traveller, and it was found on reference to the books of the plaintiffs that credit had not been given in several instances for the full amounts paid, in one case no credit at all was given. The traveller (Mr. Hully) was in court and gave certain explanations which the judge pronounced to be absurd. After Mr. Neill had proved dfferences to the extent of the plaintiff’s claim the matter was by consent referred to R. F. Thompson, Registrar of the Kendal County Court. The judge remarked there had been monstrous irregularities somewhere.

1883 28 Feb - Lancaster Gazette - LANCASTER COUNTY COURT FRIDAY. (Before W.A. HULTON, Esq., Judge). A COMPLICATED CASE. BOND v. HULLY AND OTHER. Mr. Tilly appeared for the plaintiff, and Mr. Pearson for the defendants. Messrs. R. Hully, J.S. Slinger, and T. Manners. Mr Tilly said the action was to recover the sum of £41 11s.2½d balance of account in respect of money which had been advanced from time to time. (Defendants were executors of the will of the late Mr. John Parkinson who carried out the business of a plumber in Lancaster.) Hully refs: Mr. Hully, one of the executors of the deceased, was then called, and said he made a careful search amongst deceased’s papers for anything relating to the matters of that claim. The accounts for 1873, 1879, a letter dated August, 1879, and the three receipts were given to him by deceased before he died, There was also a receipt for £25. In cross-examination, witness said that Mr. Parkinson gave him the papers four or five months before his death. He was then up, and asked him to go over the papers with him. The premium for 1881 was given to him (witness) by Mr. Bond, and during Mr. Parkinson’s lifetime. He had to press Mr. Bond very much to get it, and deceased seemed pleased that he had done so. He asked Mr. Bond if he had got the premium and he replied he had. He asked deceased how it was he had no other receipts except those produced, and he said that Mr. Bond never delivered them. Mr Bond, re-called, said it was not true that he gave Mr. Hully the receipt for the insurance for 1881. He took it to Mr. Parkinson himself on the very day it was due - the 12th October. It was the greatest untruth ever told for Mr. Hully to say it was given to him. On being cross-examined, witness could not at first say whether Mr. Parkinson was in his parlour when he delivered the paper to him. Mr Hully was not present at the time, and the premium was not paid to the Company at that time as he was the agent, and beside that there was fifteen day’s grace in which to pay. His Honour intimated that he would reserve judgement till next Court day.
1883 31 Mar - Lancaster Gazette - LANCASTER COUNTY COURT FRIDAY. (Before W.A. HULTON, Esq., Judge). BOND v. HULLY AND OTHERS. His Honour gave judgement in this case today, the facts of which will be known to our readers, a full report of the case having recently appeared in our columns. His Honor gave a verdict for the defendants, under the statute of limitations, but said he believed plaintiff’s statement as to his having advanced the premiums on behalf of the late Mr. Parkinson.

1884 06 Dec - Lancaster Gazette - AN “INTRUDER TO FREEMASONRY”, One has heard of bulls in china shops, and cows in all sorts of inconceivable places, but we question whether any one has ever heard of a cow being in a cellar beneath a Freemason’s lodge-room. The Freemasons of this town are converting the premises next to the Conservative Club in Church street into a Freemason’s lodge-room, and the cellar underneath these premises has been let to Mr. Hully, wine and spirit merchant, New-road, who occupies the adjoining premises. On Wednesday forenoon Mr Hully had occasion to go into the cellar, and was considerably surprised to find a cow there. It was, moreover, a mystery to him how the animal had got there, as there is no access to the cellar from the street.

1887 25 May - Lancaster Gazette etc THE BANKRUPTY OF A LANCASTER PALE ALE AND WINE MERCHANT - PRESTON BANKRUPTY COURT - FRIDAY (Before Mr. SADLER, Deputy Registrar.) Richard Hully, of New-road, Lancaster, came up for his first examination. The debtor’s balance sheet showed his liabilities to be £1,651.14s. and the assets were put down at £386. 6s. 1d., made up as follows: Stock-in-trade, £150; machinery, trade fixtures, &c., £140; horse, cart, jig, and harness, £60; and other items, leaving a deficiency of £1,266 7s. 11d. Mr. W.T. Sharp appeared for the debtor. The creditors represented were - the Lancaster Bank, and Mr. J..H. Cuff, of Manchester. The debtor, examined by Mr. Edelston, said he had kept books, but from these he could not tell exactly how he stood at any particular time. He had furniture both at his office and at his house, but very little of the latter belonged to him. He was willing to make a list of the furniture and supply it to the official receiver. He had a cottage in the country at Hest Bank, of which his wife was occupant. This cottage was left furnished to his wife by her father. The deficiency in his statement, £1,332 12s 7d., had, in his opinion, been growing for considerably more than three years. Mr Edelston: How long has he been in business? Debtor: About five years. The debtor, continuing, said there was a deficiency in his accounts as could be shown from his bank book in June, 1885. He believed he was insolvent in June 1885, but he could not give the amount of the deficiency then. Mr. Edelston handed to debtor a balance sheet drawn up in June, 1885, showing that he had a balance to his credit amounting to £217, and which was given by the debtor to the manager of the Lancaster Bank, and asked if that was a correct account of his affairs at that time. The debtor replied that he thought it was correct at the time, but he omitted to take off the discounts due to customers. He had put down the amounts due to him in full, whereas his customers were entitled to discounts varying from 5 to 20 per cent. The average rate of discount over the whole account would be about 17½ per cent. Mr. Edelston: That would amount to £137. That would still leave a surplus of £90 odd. Debtor: It would, sir, but in many cases where goods don’t turn out satisfactory, we have to make an allowance, and he thought he had made about £30 in such allowances. Mr. Edelston: Thre is still a surplus of about £60. How do you account for that? Debtor: I can only account for it by a mistake in taking stock at the time. Mr. Edelston: I must warn you that every word is being taken down, and I wish you to answer carefully. Was this statement of yours tendered to Mr. Saunderson, manager of the Lancaster Bank, as an inducement to continue your overdraft and trust you further? Debtor: Yes, and I thought it was correct, but it was made out hurriedly. Mr. Edelston: Can you now say whether there was surplus or deficiency in June, 1885? Debtor: There would be a deficiency, but I cannot say how much. Mr. Sadler said suggested that the debtor might have a further opportunity of explaining this point. In answer to further questions, the debtor said he sold his furniture in May, 1881, and put the proceeds into his business. He paid it into his bank. He did not remember the amount. The furniture in his house at present was left to his wife by her father, and certain real estate. The Debtor was then questioned as to his connections with Mr. Cuff. He said he acted as agent to Mr. J.H. Cuff. He had collected accounts amounting to £40 or £50, but he had not remitted it. On May 1st, he sent a cheque to the bank for £12, but it was dishonoured. Mr. Edelston thought there would be no advantage in going further into the case, as the first meeting of creditors had not yet been held. If the case was adjourned, the debtor would have an opportunity of giving a more satisfactory explanation of the account presented by him to the Lancaster Bank, and which showed a surplus of £217 1s. He (Mr. Edelston) had reason to believe that upon the faith of this statement the debtor’s account was kept open, and possibly further advances made. The Deputy- Registrar remarked that balance sheets usually were decidedly of a rosy tint. The examination was then adjourned to the 17th June next, at eleven o’clock in the forenoon. The first meeting of creditors was held at the Law Society’s rooms on Monday, when a committee of inspection was appointed.
1887 20 Jul - Lancaster Gazette etc THE BANKRUPTY OF A LANCASTER ALE AND WINE MERCHANT - At the Preston County Court yesterday, the adjourned examination of Richard Hulley, ale and wine merchant of Lancaster, was to have taken place. Mr. Sharp, who represented the debtor, said he was sorry to say that since the last hearing his client had been taken to the County Lunatic Asylum, and the superintendent had written to him stating that Mr. Hulley was still insane. He was also in a desponding state of mind, would not speak, and refused to take his food, which was administered with a stomach pump. He did not see under the circumstances what they could further do in the matter. He proposed to a make an application that the examination be closed. Mr. Edelston, the official receiver, said he promised the trustee to explain the reason of his absence that morning. He had an engagement at Manchester, and feeling that nothing practical could come out of the proceedings that day, he expressed a desire that the application should be adjourned for three months, to see if the debtor became capable of rendering a statement of his accounts. There was no desire on the part of the trustee to press the debtor unduly. Mr. Sharp was afraid his client would never be able to render a statement of his accounts, and on the suggestion of the Official Receiver the examination was adjourned until the 14th October.
1887 19 Oct - Lancaster Gazette - AN INSANE LANCASTER BANKRUPT. At the Preston Bankruptcy Court on Friday, before Mr. Sadler, deputy registrar, the examination was fixed of Richard Hully, ale and wine merchant, trading as Richard Hully and Co., 1 and 2 New-road, Lancaster. Mr. Sharp, of Lancaster, represented the debtor. The Deputy Registrar said he understood the debtor was confined in the Lancaster Lunatic Asylum. Mr. Edelston, the official receiver, said he represented Mr. Davies, the trustee, whose object was simply to discharge his duty, and who was not actuated by any feelings against the unfortunate man, but simply to be kept right by the Court. The debtor, he understood, had unfortunately become insane, and was now in an asylum. On the 27th of June the examination of the debtor was adjourned till the 15th July, and the debtor was ordered to file further accounts. That order had not been complied with, and a further adjournment till that day was ordered, but the order still remained unobeyed. Mr. Sharp: The debtor in the meantime had become insane, and conveyed to a lunatic asylum. Mr. Edelston: Yes, and what is to be done I’m not prepared to say. Mr. Sharp: I have a certificate from Dr. Cassidy that the debtor is insane with delusions, and that it is not likely he will he will be able to attend to business within a reasonable period. The certificate was produced and handed to the Deputy Registrar and Mr. Sharp under the circumstances, applied that the examination be closed. The Deputy Registrar was of opinion that it would be better to adjourn it sine die. Mr. Edelston said if the debtor was to recover, say within three months, and the adjournment was made sine die, the debtor would have to apply to the court to re-open the matter. None of them desired to put the unfortunate man to that expense, and if the Deputy Registrar had no objection, he would suggest that the examination might be adjourned for six months. Mr. Sharp said that in a conversation he had the other day with the doctors he gathered that they were inclined to consider the case hopeless. He would not eat anything, and he would not speak to anybody. Altogether it was a very bad case indeed. Mr. Sadler thought it would be better to adjourn the examination sine die, and adjourned it accordingly.

The heaviest weighed 64lbs. per quarter - the other was a little lighter. Mr. Hully also had a grand lot of sheep - the four best averaging 30lbs. per quarter. Mr. M. Hully junr., had a fine display of beef and mutton.

1892 Mar 19 - Lancaster Gazette etc - ACTION FOR BREACH OF WARRANTY - At Kendal on Wednesday,. Moses Hulley, cattle dealer, Kendal, sued John Boyd, farmer, Staveley, for £24 for breach of warranty of the sale of a cow. Plaintiff stated that on December 30th he bought a cow from defendant for £16. Defendant pronounced his cow “right and straight,” although he did not actually use the word “warrant.” On the same day plaintiff sold the cow to Mr. Huntingdon, of Lancaster, for the same price as he had given for her, and had also given a verbal recommendation similar to the one given to him by the defendant. The day following Mr. Huntingdon’s purchase, the cow took bad ways, and afterwards died. Mr. Huntingdon entered an action against the present plaintiff for breach of warranty, and obtained a verdict for £17. The plaintiff now claimed the amount of the verdict and added costs, which amounted to £24. Defendant denied giving a warranty further than stating that the cow was “right and straight.” The Judge said he felt satisfied that the defendant did not take upon himself to warrant the cow, therefore judgement must be given in his favour.

I have a marriage certificate for Elizabeth Hully age 19 on the 7th November 1880 - She was my Grandmother's mother, (on my mothers side.) She married Frederick Stevens (age 25). They were married at St Mary's Edge Hill in the Parish of West Derby in the County of Lancaster. Frederick was a Railway Porter living at number 26 (I think) Shaftesbury Terrace - his father was George (writing is terrible but it looks like George) who was a pensioner with the Royal Horse Artillery. Elizabeth at the time of her marriage lived at Laudstone Road (again writing is difficult to read) - her father was Moses Hully, Cattle Dealer. I see one of the marriage witnesses was a Catherine Jane Hully - possibly a sister or cousin? August 1851 of Isaac Creighton & Hannah (Jackson) Rydal & Loughrigg Ambleside. Hannah died when 2nd dau. Ann was born 1854. Tamar was housekeeping for her Uncle Isaac Creighton & wife Ruth in 1881/91 census returns latterly living at Ferney Green (v. near House of Correction Hill where Moses lived) She benefits from Isaacs will & codicils1895/97 £300 providing she stays in 'the service of Isaac & Ruth as long as they live'... Isaac died 1897 & Ruth (my gg.grandmother)1899 Margaret Ann Hully-dau. of Moses & Elizabeth .was also mentioned but all was revoked by codicil.

2014 12 Nov - email from Marlyn Morgan:- Hi Ray, I was so impressed with the beautiful commemorative field of poppies around the Tower of London. I wish I could have been there in person to donate a clay poppy in Frank Hully's remembrance. I used a site on Ancestry developed specifically to record and make known the ancestors who died in WWI. I found that he was buried in Picardie on July 4, 1917 of wounds suffered before that day. If we can arrange to be in France in 1917, we shall lay a wreath there. 2012 08 Aug - note from Marilyn Morgan USA: Unfortunately though Isaac's bloodline continued through his son John, my mother, myself and my kids and grandkids, there was no one to carry the Hully name forward after John died prematurely in early 1920. The U.S. census of 1910 shows that Francis, his wife Mary and their son Frank were residing in Newark possibly till the Great War.
