1865 Mar 25 - Preston Guardian - County Court - Jury Case -- Was the Cow Sound at the time of sale? -- Oddie v.
Proctor (incl) - p Johnson Lord, a little boy said: I was at Gisburn and fair, with Robert Hully, about
Christmas. I saw Proctor's boy; he had a cow in a halter. It laid down in the road, about 2 1/2 miles from
Gisburn. He began crying, and asked if we would help him up with it. Hully got hold of its head, and I
got hold of its tail, but it would not get up. Hully then trod on its tail, and it then got up, and we went on.
Robert Hully said: I am a cattle dealer, in the employ of Mr Green, Manchester. I attend Gisburn fair
regularly etc. His Honour summed up, and the jury returned a verdict for the plaintiff, £10 and costs.

1884 21 Oct - Manchester Courier and Lancashire General Advertiser. STEALING A PONY AND CART - At the
Manchester City police-court, yesterday, before Mr. F.J. Headlam, a man of no fixed residence, named
John Vickers, was charged with stealing a pony and cart, valued at £20, the property of Robert Hulley,
butcher, Bolton-road, Pendlebury.On Wednesday last, the coimplainant was Spier-street, Stevenson
Square , on business, and he asked the prisoner to look after the pony and cart. When he returned,
however, the prisoner and the pony and cart had disappeared. They were traced to Stockport, where he
had tried to sell them to a lodging-house keeper. He was sentenced to three months' imprisonment with
hard labour.

1900 23 Nov - Leeds Mercury - PIGEONS, POULTRY, AND PEOPLE IN ONE HOUSE
At Whitehaven yesterday, John Hully, (56), labourer, and his daughters, Elizabeth and Annie, single
women, of Paston, were each sent to gaol for two months hard labour for wilfully neglecting their
children. The evidence revealed a shocking condition of things. Defendants lived in a five-roomed
house, which was filthy, and seven children, five of whom were illegitimate, the offspring of the female
defendants, all insured, were in an awful condition. The children and women slept in one room, and an
adjoining room was utilised for pigeon and poultry. The Inspector of the National Society said he had
never seen anything to equal such neglect.

1900 24 Nov Maryport Advertiser - SHOCKING NEGLECT OF CHILDREN AT PARTON.
CHILDREN COVERED WITH VERMIN. A DISGRACEFUL STATE OF AFFAIRS
John Hully, 56, Labourer, Parton, was charged by Walter Hart, Inspector of the
N.S.P.C.C., Carlisle, with wilfully neglecting his children, at Parton on the 6th
November. Elizabeth Hully, 34, single woman, Parton; and Annie Hulley, 29. single
woman, Parton, were charged with the same offence.
Mr. W. Dickinson, solicitor, Whitehaven, said he appeared to prosecute on behalf of
the National Society for the Prevention of Cruelty to Children, Carlisle. He related the
facts of the case, then called Walter Hart, who stated that he was an Inspector of the
Society for the Prevention of Cruelty to Children, and lived at Carlisle. He knew the
three defendants. He made his first visit to their house in Main Street, Parton, on
June 13th, 1899. He then saw the three defendants and seven children at that time.
The names of the children belonging to the male defendant were, Kate, aged 14; and
Alice, aged 12. Elizabeth Hully’s children were Frank, aged 12; Sarah Elizabeth,
aged 5; and Robert, one year and five months. Annie Hully’s children were Sarah
Agnes, 10 years; Thomas 5 years; and a baby one month old. All the children were
fairly well nourished, but were badly clothed, and their heads were a mass of vermin
and scabs. The children were grinding in dirt. The child, Alice, appeared to be
exceedingly delicate and very miserable, and she was suffering from hip disease,
caused by her having a fall three years ago. He told her mother that the child should
have proper medical attention.
Mr. Dickinson: Was she receiving medical attention? - No, she was not. She had
been seen by a doctor after the fall some years previously.
Continuing, witness said the two women were at home when he called. Annie Hully
went out to work, while Elizabeth Hully looks after the house and the children. The
women tod the Inspector that the children were all illegitimate, excepting those
belonging to the male defendant, which were by his second wife; and the Inspector
was also told by the women that that only one of the children had been fathered,
but they did not say which one.
Was anything said as to insurance?
Yes, the women said th children were insure in the Refuge.
The Chairman: All of them?
Witness: yes, sir.
Mr. Dickinson: What condition would you say the children were in? - They were in
an extremely wretched condition and were miserable together. The house consisted
of five rooms, three on the ground floor, and two on the upper floor, also an attic.
What is on the ground floor? The front room leading to the street. This is a good
sized room, and appeared to be used as a lumber room. There was only a chest of
drawers in it; there were no chairs that he saw.
Defendants: There were five chairs in the room.
The Clerk: You are speaking as to what you saw in 1899? Yes, sir.
Continuing, witness said behind the front room was a small bedroom, just large
enough to hold one bed. That bed was occupied by John Hully and a son, who had
been invalided home, but had since left home.
What did you see as to the bed and bedding? - It was in a very dirty condition, but it
was not so bad as the bedding of the children.
You went upstairs? - Yes, and I found one room occupied by the two female
defendants. In it there were just two bedsteads. There was no furniture of any kind.
This room was occupied by the two women and the seven children.
What was the condition of that room and bed? - The room was in a very filthy
condition and he supposed it had never been washed. The beds were simply
saturated with urine and excreta, and the stench in the room was simply unbearable.
As a result of your visits written warnings have been sent? - Yes. I had a long talk
with the defendants and told them that they would certainly be prosecuted if things
were not remedied. The following day he sent them a warning by post.
What date was your next visit? - On October 5th, 1899.
What condition did you find the children in on that date? - I found no change, except
that their hair had been cut. They were still in a verminous condition. They were suffer-
ing from scabs all over the head, and were still in a miserable condition. The house
was still in the same filthy condition. On that occasion he found a bucket brimming
over with urine and excreta on the stairs. The room immediately behind the one
occupied by the women had been turned into a pigeon loft, and the stench from this
room was very bad indeed. He warned the defendants and told them to remove the
pigeons. On the 19th of October 1899, he made his third visit, an d on that occasion
he considered the children were in a somewhat improved condition. Their heads
were less verminous, an d the defendants had been applying ointment. The pigeons,
however, were still there, and six poultry as well. He then communicated with the
Sanitary Inspector, with the results that the pigeons had been removed. The date of
his next visit was the 31st October this year.
Did you find any of the improvements had been maintained or not? What was the
state of the children? I did not see all of the children. Kate and Sarah Agnes were
away, and I could not find them anywhere. The other children were in a filthy and
extremely verminous condition, and in almost as bad a state on his first visit,
The Chairman- They were worse on your third visit? - Yes.
Did you find any of the children, particularly more bad than the others? The elder
children were certainly the worst. Alice was very bad indeed.
What do you say as to the general condition of the children? - Alice is almost of a tan
colour. Her face was white, as the Bench could see, but her body is quite a tan
colour. They say it is the natural colour of the child, but I could not say that. I
attempted to remove some of it with soap and water but I could not make any
impression. The hous is still in a filthy condition indeed, more especially the room
occupied by the children.
on the 31st October did you visit the front room particularly? - Yes. I saw nothing
more than on my first visit. I sa no chairs and no signs of them living in the front room.
The bed in the upstairs room was even worse. The pillows were filthy with grease
and dirt, and one bed the woman would let me see, because she said her sister had
been confined three weeks previously and nothing had been dne to the bed. The
stench in the room was something fearful. On that occasion he thought it necessary
to call in further evidence, and he called in Dr. Castles. The doctor saw the bedding
and other things. His next visit was on November 6th, when he saw all of the children
including the baby.
What was the condition of the children on your last visit? - They were not sufficiently
improved for him to give any opinion.
There had been a superficial cleaning of the bedding. He saw the two children. Kate
was certainly cleaner than the others and paraffin oil had been rubbed into their heads,
and it had destroyed the vermin. As regards Agnes she was simply alive with body lice,
and the defendant, Elizabeth, then admitted that she was verminous. The other children
were very little improved, and they were miserable. There was very little alteration in
their condition. He did not think he had ever seen a girl more verminous than Agnes
was; she was simply alive. The house was still in a filthy condition. He had been in
hundreds of houses during the time he had been Inspector for the Society, but he had
never seen a worse case of absolute filth than this house.
The male defendant: You say there is no furniture in the place at all? - I did not say
that. I said I saw a chest of drawers, but there were not five chairs.
Defendant: In the room where I sleep there is a dressing table and two chairs.
Dr. Henry Castles stated that he lived at Distington. He was called in to see the
defendant’s house by the last witness on the 31st October this year. He saw the
defendants John Hully, Elizabeth Hully, and Annie Hully, and six children viz. Alice
Sarah Elizabeth, Frank, Thomas, Robert, and a baby three weeks old, and he
examined them.
What condition were these children in? - They were covered in lice.
Did you see any signs of any care? - They were very dirty, and their clothes were very
dirty.
Were their bodies clean? - I had Alice undressed. Shew was badly flea bitten. Her
body had not been washed for years. Her hair had been cut short. Alice had hip joint
disease. There had evidently been nothing done to it. There was no dressing or any-
thing on it. It was an open sore and was running.
By the Bench: The wound would require dressing.
Continuing, witness said the diseased hip had not been attended to for some time,
and this, in his opinion, would cause the child unnecessary suffering. The lice on the
girl’s head had actually caused an eruption on the head. It had been eaten away by
the lice. The head of one of the other children was in a somewhat similar condition.
What was generally the condition of the house? - It was very filthy and the beds were
undescribable, and he never saw anything like it. One had much better sleep in a
midden than on one of those beds.
Continuing, witness said the floors of the rooms had not been washed when he visited
the house. There was no furniture in the back room as far as he could recollect, and
he thought there was nothing but one bed.
In the upstairs room there were two beds and you said you would prefer to lay on a
midden rather than them? Did you see the two beds that one of the women refused to
let the Inspector see? - Yes. The woman turned the Inspector out. The bedding was
perfectly black, and there was evidence that some person had been confined and there
was a quantity of blood in the bed. The woman said her sister had been confined three
weeks since, and that was the reason why she would not let the Inspector see it.
dr. Castles, in reply to the Chairman, said he had not been in the house since the 31st
October.
The Clerk: You do not care about going again.
Dr. Castles: I saw quite sufficient.
P.C. Steele said he visited the defendants’ house on the 31st October this year. He
had known the family for three years, and he considered that the children had been
kept in a dirty and a miserable condition. The house was in a very filthy and dirty
state. On the same day he saw Sarah Agnes, whose head was a complete mass of
scabs and vermin. Kate’s head was in a similar state.
Elizabeth Graham stated that she was school mistress at Parton. She had known
Kate, Alice, and Sarah Agnes Hully for two years. They were very dirty and had sore
heads, and she had had to send them from school on that account. She had also
visited the parents and told them about the children’s condition. On the 16th of May,
1899, the children were sent home as they were not fit to be amongst the other
children, and she again visited the defendant’s house and told them to clean the
children, or she would have to send them from school. Sarah Agnes came back on
January 22nd, but as she was no better, witness had again to send her home. The
children had, however, come back during the past fortnight.
John Thomas Spencer, master of the boys’ school, Parton, said he had known Frank
Hully for some seven years. His condition was dirty and verminous almost from the
first he knew him. He had had to order the boy out of school on account of his
condition. The vermin must have caused the boy injury, and the disposition of the
other boys in the school, who would not sit beside him must have caused him mental
injury. The boy was not now attending his school. hew boy had been sent back, and
on the occasion he said his clothes had been “stoved” to kill the vermin.
The Inspector: The women told him that the children were insured in the Victoria, but
that they were in arrears.
Mr. Dickinson said he would not press that point now.
The defendants had practically nothing to say.
The Bench retired and on their return the Chairman said: The evidence in this case
discloses a very sad and disgraceful state of affairs, and we have decided to send
each of the defendants to Carlisle Gaol for two months, with had labour.
The Clerk said the children would be looked after by some responsible person and
the magistrates would make an order to that effect.
Mr. Dickinson applied on behalf of the Society that the fees be remitted, and the Bench
agreed to the application.

1870 26 Nov - Lancaster Gazette - FISHERY PROSECUTIONS AT SHAP
(inc.) Mr. Sharp appeared on behalf of the Lunesdale Board of Conservators, and the case was proved
by Thomas Hully, a farm servant, who stated that he saw Richardson and Sisson throwing stones into
the Lune on last Sunday week at a salmon, which they chased for about 100 yards. Richardson then
threw in a pair of hooks, and drew the salmon out, taking it away with him under his coat. Potter, was
on the watch to see that no one came. Hully, however, saw the whole transaction from a neighbouring
place of concealment. Richardson, who pleaded guilty, was fined £2 for the offence and £1 for the
salmon. the other defendants were fined £1 each and costs.

1877 15 Aug - Lancaster Gazette - LOCAL INTELLIGENCE - FISHING WITH AN ILLEGAL NET.
At the Ulverston Police Court on Thursday afternoon, John Bird and William Jonson, fishermen, were
charged with killing salmon with an unlawful net in the Leven, near the Ulverston Viaduct, on the 31st of
last month. Mr. F. Taylor, Barrow, appeared for the defendants, whilst Mr. S. H. Jackson, secretary to the
Kent Fishing Board, prosecuted.
Thomas Hully, water bailiff, proved finding the two defendants fishing with a net on the 31st of July,
which he believed to be of unlawful mesh, on measuring it he found it to be about an inch and a quarter
from knot to knot, instead of the regulation size of an inch and a half. He then seized the net, boat, and
twelve morts and a salmon, which were in possession of defendants. Afterwards Hully left his capture in
the hands of a policeman, McGarroty, whilst he went to a farm for a cart to take away the net &c. In his
absence the defendants returned with assistance and took the boat, net, and fish from the policeman.
Defendants now produced a net in court, which, although of illegal mesh, Hully declared it was not the
one he took. Mr. Jackson said if the defendants would agree to pay all costs, and hand over the net to
be destroyed, the Board would not press this case. This they would not agree to, so the magistrates
convicted in a penalty of £5 each and costs, and ordered the net to be destroyed.

1882 28 Oct 28 - Lancaster Gazette - GAME TRESPASS NEAR KENDAL. At the County Police court, Kendal, on
Saturday, George Bell was charged with trespassing in pursuit of game at Helsington, on the 16th
inst., and also with assaulting two watchers named Hully and Douglas. A companion, Joseph Brooks,
was charged with assaulting the watcher Douglas. Prisoners were caught ferreting with another man
not in custody, and they set upon the watchers. Douglas was struck with a large edged stone in the
face. Bell was fined 8s. and costs or a month’s imprisonment for trespass, a month’s imprisonment for
assaulting Douglas, and the same term to follow for assaulting Hully and to give sureties for his good
behaviour. Brooks was sentenced to one month for the assault.

Conductor F Hully Woolwich 1891 Francis Hully Born 1851 Orton Westmoreland and Died 1926 in Malta, at the time of his retirement he was a Naval Ordnance Officer. On his tombstone in Malta it has him Born 1851 Orton, Westmoreland, Deputy Naval Ordnance retired, buried 17th March 1926. In the 1880’s he was in the Army and the regiment detail are ASC.ord & MSSC in the 1891 census he was 39 years old and based at Woolwich and his rank was CONDUCTOR OSC, Its said that he was Married in Cyprus between 1878 and 1880 to an Ellen 1891 census says” born Malta British Subject” and two of his Children were born there, others were born England and Malta.

On the 25th May 1915, HMS Triumph was sunk at Gaba Tepe and a seaman named Wall was seen to
be in difficulty in the sea. Hully jumped in from another ship and supported him till both were picked up.

Eric Louis the son of Arthur George and Louisa. Eric was in the R.A.F.

William 1853 (sic) - 1937 was in the police at Whitehaven and then ran a country inn until his death.
James 1894-1977 was also in the police at Cockermouth. William Varey Hully 1892-1965 migrated to
Australia where his daughter Pauline was living. His son William also migrated to Australia.
