Hulley de Diggbanke. Note:- Digbanke/Digbonke was situated immediately south
of the old St Michael's parish churchyard. Coal was dug from this location.

1684 - wife was 'late of Digbancke' when buried. Digbank was situated south of the
original churchyard of St Michael's parish church, Ashton under Lyne. See
'England in Ashton under Lyne' by Winifred M. Bowman 1960.

HULLEY of Ridgehill in ye Parrish of Ashton under Line & County of Lancaster
Husbandman being Crasey and weake of Body but of perfect mind and memory
thanks be given to Almighty god for ye same Doo make this my last Will and Testament
In manner & form following that is to say principally I give & recommend my Soul into
ye hands of Almighty god my maker having through the merits death and passion of
Jesus Christ my Saviour to obtain full & free pardon and forgiveness of all my sins, and
for my body I recommend itt to ye earth to be Buried In Such Decent Sort as my
executors shill think fitt; and as for such worldy estate as itt hath pleased god to bless
me withall in this life I doe give devise & dispose them in ye following manner & form:
Imprimus I will that all my Debts funarall expenses ye probate of my will the exipition of
an Inventory be paid & deducted out of all my personall estate & temporall goods; Item
I doe hereby give & bequeath to my daughter SARAH wife of THOMAS COTTERILL all
my Beding whatever & five shillings in money to be paid and given to her; Item I doe
hereby give to my son JAMES one shilling in full of all bequeathed whatever and as for
the Rest Residue & Remainder of all my personall estate & temporall goods
whatsoever I doe hereby give & bequeath them all to my Two Sons JOHN and
ROBERT to be equally divided betwixt them part & part Alike Item And Lastly whereas I
did refer to my Selfe a parcell of housing belonging to mee called by the name of ye
Loomhouse which I did except when I did settle ye other of my Sone JAMES leaving
that out att my disposall, And I doe hereby give all my title Naime tenantright property
whatsoever in and to the housing before mentioned hearby & Absolutely after my
decease for ever unto my Sone JOHN HULLEY his heirs and Assignese for ever, to
come & go to and; be used by him & his as shall be for their advantage & without
Disturbance by any persons or person whatever And I doe hereby make and ordaine

LETTERS OF ADMINISTRATION FOR THE ESTATE OF JOHN HULLEY OF RIDGE
HILL ASHTON UNDER LINE 1722

THE CONDITON of this Obligaton is such that if ye above Bounden WILLIAM
COTTERAL Nephew & Administrator of all and singular the goods chells and credits
of JOHN HULLEY of Asheton Undr Line Mason lately deceased doo make or cause
to be made a true and perfect Inventory of all and singular the goods chattells and
credits of the said deceased which have or shall come to the hands possion or
knowledge of him the said WILLIAM COTTERAL or into the hands or possession of
any person or persons for him and the same soe make do or exhibit or cause to be
exhibited into the Registry of ye Constistory Court at Chester at or before the fifth day
of April next ensuing And the same goods chattells and credits of the said deceased
at the time of his death which at any time after shall come to the hands or possession
of the said WILLIAM COTTERAL or into the hands or possession of any other person
or persons for him doe well and truly administer according to law And further doe
make or cause to be made a true and just accompt of his sd Acton at or before ye
Sixth day of January 1723 and all the rest and residue of the said goods chattells and
credits which shall be found remaining upon the said Administrations accompt the
same being first examined and allowed of by the Judge or Judges for the time being
of the said Court shall deliver and pay unto such person or persons respectively as
the said Judge or Judges, by his or their decree or sentence psuant to the true intent
and meaning of a late Act of Parliament made in the two and twentieth and three
and twentieth yeares of the raign of our Late Soveraigne Ld. King Charles the
second (Intituled An Act for the better settling of Intestates (& states) shall limitt and
appoint And if it shall hereafter appeare that any last will and Testament was made
by the deceased and the Executor or Executors therein named doe exhibit the
same unto the said Court makeing request to have it allowed and approved
accordingly if the said WILLIAM CATTERAL above bounden being thereunto
required doe render and deliver the said Lwes of Acton (approbaton of such
Testament being first had and made) in the said Court Then this Obligaton to be
void and of none effect or else to remaine in full force and vertue.

Note: the above marriage may not be correctly located because when James Hulley died in 1719 he made no mention of a wife Hannah/Ann in his will. Further research will need to be undertaken to establish whether this James Hulley did in fact marry Hannah Harrison in 1715-16.

HULLY of Ashton underline in the County of Lancaster Mason being wake of Body but of
Sound and perfect mind and Memory thanks be given to Almighty god for the same doe
ordaine and make this my Last will and Testament in Manner and forme following (that
is to Say) first and principally I bequeath my Soul and Spirit into the hands of Almighty
god And my Body I Commend to the earth to be decently Buried att the discretion of my
Executors hereafter named and as Touching such Temporall Estate as it hath pleased
Almighty god to bestow upon me I give leave & bestow as followeth first it is my will and

the orrigonall Indenture of Lease thereon made upon This Condition that the said
JOHN HULLEY my son or his Assignees shall and will well and truly pay or Cause to
be paid unto WILLIAM HULLEY my son the sume of Seven pounds of good and
Lawful money of great Britaine ear ever he or they enter upon the said housing where
I now dwell and it is my will and minde that my son JOHN HULLEY or his Assignees
shall and will of his or there owne proper Cost and Charges repair the roofe over the
house where I now live dureing the Terme hereby granted determined as Aforesaid
Itm I give and leave and devise to ROBERT HULLEY my son his Lawfull Issue and
Assignees all that Lower house where JOHN GEE now Liveth which belong to me
for and dureing all the time and Terme of ye orrigonall Indenture of Lease thereon
made hee the said ROBERT HULLEY or his Assignees paying and discharging of the
Claire Issues and proffitts of the said house the sume of Eight Shillings a year yearly
of Lawfull British money during the Terme of the Orrigonall Indenture of Lease

1719 18 Jun - Inventory made of all goods etc by Thos. Walker, Robert Hulley (son). Total value =
£1.12s.7d.

Main benificiaries of will:

1. Sarah my daughter: the sume of one shillinge in full of her child's part.

2. Mary my daughter: the sume of one shillinge in full of her child's part.

It is my will & mind that the Cubboard in my house and bed Stead in the Parler be Left unsold and stand for Heire Loomes in the house while the house Continues in the name of Hulley.

3. last Will and Testament In manner & form following that is to say principally I give & recommend my
Soul into ye hands of Almighty god my maker having through the merits death and passion of Jesus
Christ my Saviour to obtain full & free pardon and forgiveness of all my sins, and for my body I

my will and mind that if default be made in payment of the Aforesd. Sumes of Seven
Pounds and Eight Shillings A yeare before expre that then and In Such Case I doe
hereby Authorise and Give power to my Executors hereafter named to enter upon the
premises and the same to hold occupie & enjoy till the aforesaid sume of Seven
pounds be paid and discharged to my son WILLIAM HULLEY and the yearly sume of
Eight Shillings a year to my son ARTHUR HULLEY be Secured as Aforesaid And I
doe hereby Constitute ordane and appoint ROBERT HULLEY my Brother of quick
Sadleworth in the County of York Cloather and JAMES HULLEY his son Executors of
this my Last will and Testament hopeing the(y) will see the same performed
According to my sure Trust in them Reposed and I doe hereby fustrate make void
and disanull all other former wills and Testaments by me made and doe declare this

Monumental Inscription in St Michael's church graveyard, Ashton under Lyne -
Robert Hully died ye 9 day of Nov. 1731 Aged 73 years.
Likewise the Body of Robert Son of James Hully. Buried March ye 3 1735 Aged 7 years.
Also Jane his Daughter was buried May ye 21st 1744 Aged 18 years.
Esther Wife of James Hulley Buried July 31st 1753.
Also the body of the aforesaid James Hully of Luzley end who departed this life January 24 1763 in his
75 year.
Also Elizabeth his daughter and Wife to Jonathan Cocker dep. April ye 21 1765 Aged 37 years.
