This is the last Will and Testament of me JONATHAN HOOLEY of Sutton in the county of
Chester Twister in the first place I give devise and bequeath all and singular my real and
personal Estate of what nature or kind soever and wherever unto THOMAS ALLEN of
Macclesfield in the county of Chester Gentleman and my brother JAMES HOOLEY of
Sutton aforesaid their Executors and Administrators according to the nature of the said
Estate and property respectively Upon Trust that they the said THOMAS ALLEN and
JAMES HOOLEY and the Survivors of them and the Heirs Executors or Administrators of
such Survivor shall and do as soon as conveniently may be after my decease sell and
dispose or all and singular my Freehold Copyhold and Leasehold Estates and other
property of a saleable Nature either together or in parcels as to them shall seem meet
and also to make execute and perfect all necessary or proper Deeds Writings
Conveyances and Surrenders and Assurances for the purpose of vesting the same in
any purchaser or purchasers thereof as he or they shall direct or appoint AND I hereby
declare and direct that the receipt or receipts of the said Trustees or Trustee for the time
being shall be a good and valid acquittance and the Purchaser or Purchasers of all or
any part of my said Estate hereby directed to be sold for all or any part of the Money to
be by them or him paid for the same, or so much thereof as shall be therein
acknowledged to be received And that the Purchaser or Purchasers shall not be
afterwards answerable or accountable for the Misapplication or Nonapplication of the
same or any part thereof AND I do hereby will direct and declare that they my said
Trustees do and shall stand possessed of and interested in the Money to arise by such
Sale or Sales and also of and in the rest and residue of my personal Estate and Effects
after payment of Mortgages & Debts and the charges and expences attending the
execution of the Trust of this my Will IN TRUST to lay out and invest the same upon
Government or real securities at interest in the Names or Name of my said Trustees or
the Survivors of them or the Heirs Executors or Administrators of such Survivor and do
and shall alter and vary the same as and when they shall think proper and also do and
shall pay apply and dispose of the rents issues and profits of my said Estates and
Effects in the mean time and until such sale Upon the trust and for the several Ends
intents and purposes hereinafter expressed concerning the same, that is to say, IN
TRUST to pay apply and dispose of the interest Dividends and other proceeds of the
funds and Securities upon which the said Monies shall be so invested and of the rents
issues and proceeds of all my Estates and Effects whatsoever, until Sale and
Investment, unto my dear Wife ELIZABETH otherwise BETTY HOOLEY for and during
the Term of her Natural life And from and immediately after the decease of my said
Wife Upon Further Trust that they the said THOMAS ALLEN and JAMES HOOLEY and
the Survivors of them and the Heirs Executors or Administrators of such Survivor do pay
transfer and assign all and singular the said Trust Monies and the Funds and
Securities wherein the same shall be placed or invested unto amongst and between my
three Sons JOHN, JAMES and JONATHAN and my Daughters ELLEN HOOLEY and
ANN THORLEY equally share and share alike AND LASTLY I do hereby nominate and
appoint the said THOMAS ALLEN and my Brother JAMES HOOLEY Executors of this
my Will IN WITNESS whereof I have hereunto set my hand and Seal this Sixth day of
July in the Year of our Lord One thousand Eight hundred and ten.

This is the last Will and Testament of me JAMES HOOLEY of Sutton in the Parish of
Prestbury and County of Chester Yeoman First I order and direct that all my Just Debts
Personal and all other necessary expences be first paid out of any personal Estate and
if such personal Estate proves insufficient for that purpose then I charge my real and
copyhold estate therewith I also give and devise all that my Freehold Messuage or
Dwelling house situate in Mill lane in Sutton now in the holding of JOHN JOHNSON
Slater unto my Nephew JOHN HOOLEY his heirs and Assigns for ever I give and devise
to my said Nephew JOHN HOOLEY all those Messuages Cottages and Dwelling
houses situate and standing and lying in Guncar lane in Sutton aforesaid one of which
Cottage or Dwelling house I lately purchased from my Brother JONATHAN HULLEY
and in Copy hold all which Dwelling houses I give and devise as before stated unto to
my said Nephew JOHN HOOLEY subject to the payment of the sum of Eighty Pounds to
his Brothers and Sisters as follows to wit Twenty Pounds to his Brother JAMES
HOOLEY Twenty Pounds to his Brother JONATHAN HOOLEY Twenty Pounds to his
Sister ELLEN HOOLEY and the remaining Twenty Pounds to ANN the wife of JOSHUA
THORLEY his other sister making the said sum of Eighty Pounds all which sums I
direct shall be paid with Interest in three Years after my decease And all the rest
residue and remainder of my property whether real or Personal I give devise and
bequeath unto and amongst my said Nephews and Nieces share and share alike and I
do hereby nominate and appoint my said Nephew JOHN HOOLEY JOHN NEWTON of
Macclesfield Weaver and WILLIAM SHATWELL of Sutton Cotton Man Executors of this
my Will and revoking all former Wills and declare this only to be my last Will and
Testament In Witness whereof I have hereunto set my Mark and Seal the twenty eighth
day of January one thousand eight hundred and eleven

take upon him the Execution of the said Will, when he shall lawfully request the same)
and he further made oath that the personal estate and effects of the Testator within the
diocese of Chester were under the value of Twenty Pounds
