for the Same) Do make and declare this my last will and Testament in manner and form following (That is to Say) I order and direct that all my just debts funerall expenses and the charge of the Probate of this my will be paid and discharged by my Executors hereafter named out of my personall Estate And I desire that my body may be buried in a decent manner at their discretion And as to such worldly estate wherewith it hath pleased God to bless me I dispose thereof as follows (To Witt) FIRST I do hereby ratify confirm the Settlement by me heretofore made of and concerning the messuage or Dwelling house in Macclesfield wherein I now Dwell and all and every the uses and Limitations therein mentioned and expressed Also I do hereby give and devise unto my sons THOMAS HOOLEY and JOHN HOOLEY and my daughter REBECCA HOOLEY my Executors hereafter named and their Assigns All and every my messuages Burgages Lands Tenements and hereditments whatsoever Situate and being in Macclesfield aforesaid and in Heaton Norris in the County of Lancaster or elsewhere in the sd Countys of Chester and Lancaster with their and every of their rights members and appurtenances for and during the naturall life of my loving wife HANNAH HOOLEY They my said Sons and Daughter THOMAS JOHN and REBECCA takeing heed that my sd Wife be properly provided for and taken due care of for her life and As for and concerning All that my messuage or Burgage in Macclesfield aforesaid wherein I now dwell (except that part therein called the Hough end) And also all that other messuage Burgage or Tenement commonly called the Waters and Also all that Croft or parcell of ground Situate and in Macclesfield aforesaid near to the said last mentioned messuage or Burgage I Give Devise and Bequeath the same give and bequeath the same from and after the death of Such my said Wife unto my said Son JASPER HOOLEY his Executors Administrators and Assigns for and during all my Estate Term and Interest therein to come and unexpired AND AS FOR AND CONCERNING All those Clover fields pieces or parcells of land in Macclesfield aforesaid commonly called the Bowfields which were lately purchased from GODFREY ATKINSON Esquireand his Son I give devise and bequeath the same with their and every of their rights Members and Appurtenances imediately from and after the death of my Wife unto my Son THOMAS HOOLEY his heirs and Assigns for ever AND AS FOR AND CONCERNING All that messuage Burgage or Dwelling house in Macclesfield aforesaid in a Street there called Back Street now in possession of Mr JOHN ASHWORTH and next adjoyning to the Dwelling house of WILLIAM BOOTH AND also All that other Messuage or Burgage Situate and being in Macclesfield aforesaid in the Same Street adjoyning to the West side of my now Dwelling house and commonly called or known by the name of Houghsend before mentioned I give devise and bequeath the Same together with their respective rights members and appurtenances from and imediately after the death of my said Wife unto my Son JOHN HOOLEY his heirs and Assigns for ever AND AS FOR AND CONCERNING my personall Estate I give and bequeath the Same (subject as aforesaid) in manner following (To Witt) I Give and bequeath unto my Daughter MARY HOOLEY Wife of my Son in law JASPER HOOLEY the Sume of Sixty pounds to be paid her within Six months after the death of my said Wife ALSO I give and bequeath unto my Daughter HANNAH SAUNDERS Wife of THOMAS SAUNDERS of Hampwich in the said County of Chester Grocer the Sume of Two hundred and fifty pounds to be paid to her within Six months after the decease of my said Wife ALSO I give and bequeath unto my said Executors hereafter named their Executors and dministrators the Sume of Two Hundred pounds IN TRUST that they my sd Executors and the Survivors of them their Executors or Administrators Shall and will within Six Months next after the death of my sd Wife place and continue the Same out at interest and during the life of JOHN HOOLEY of Macclesfield aforesaid my Son in law pay the Yearly or other interest or produce of the said Two Hundred pounds from time to time to the proper hands of ELIZABETH HOOLEY my Daughter (Wife of the sd JOHN HOOLEY) for her Sole and Separate use so as that the Same nor the Principall Stock shall be in any wise answerable for the debts or engagements of her sd Husband for which payment her sole receipt or receipts Signed with her proper hand shall notwithstanding her coverture be a sufficient discharge AND upon the death of her sd husband in her life time IN TRUST to pay the Same principall Sume of Two hundred pounds and all interest for the Same then in arrear unto my said Daughter ELIZABETH her Executors or Administrators but if my sd Daughter ELIZABETH shall happen to dye in the life time of her said husband then and in Such Case IN TRUST that they my said Executors their Executors or Administrators shall the said principall Sume of Two hundred pounds and all interest then in arrear unto and amongst the Child or Children of my said Daughter ELIZABETH Share and Share alike if more than one and if but one then wholly to such only child But if my said Daughter ELIZABETH shall happen to dye in the life time of her said husband leaving no issue of her body living at the time of her death Then IN TRUST to pay the Same to the said JOHN HOOLEY my Son in law ALSO I give and bequeath unto my daughter REBECCA HOOLEY the Sume of Four hundred pounds AND to my Eldest Son JASPER HOOLEY the Sume of One hundred pounds AND to my Son THOMAS HOOLEY the Sume of Two hundred pounds and to my Son JOHN HOOLEY the Sume of Four Hundred pounds to be paid to them respectively within Six months after the death of my said Wife ALSO I give and bequeath unto my Son WILLIAM HOOLEY the Sume of Two hundred pounds to be paid to him within six months next after the Death of my said wife But in Case of the death of my sd Son WILLIAM before the payment of the sd Sume of Two hundred pounds Then I give and bequeath the same unto and amongst the Child or Children of my said Son WILLIAM lawfully to be begotten share and share alike if more than one and if but one Then wholly to such only Child But if my said son WILLIAM shall happen to dye before he shall have received the said Sume of Two hundred pounds herein before intended him leaving no issue lawfully begotten by him that shall be living at his death THEN AS CONCERNING the sd Sume of Two hundred pounds I give devise and bequeath the same unto and amongst my own Child or Children equally amongst them Share and Share alike ALSO I give unto my Son in law SAMUEL SMALLWOOD the Sume of five Shillings and no more ALSO I give unto my Grandson WILLIAM SMALLWOOD the Sume of Fifty pounds AND to my Granddaughter REBECCA SMALLWOOD the Sume of One Hundred pounds to be paid them respectively at the discretion of my said Executors AND AS CONCERNING all my goods Chattells Effects Money Debts to me oweing and all my other personall estate whatsoever (Subject as aforesaid) It is my will and mind and I do order and direct that my said Sons THOMAS HOOLEY and JOHN HOOLEY and my said Daughter REBECCA HOOLEY my Executors hereafter named (In confidence of the great care that they will take of my sd loving wife for life) shall have the use benefitt and advantage of all my sd goods Chattells Effects money Debts and all other my personall Estate whatsoever for and during so long time as she my sd wife shall happen to live AND after her decease AS CONCERNING all my household goods plate linnen even all the furniture of my now Dwelling house I give and bequeath unto my said Daughter REBECCA AND all the rest residue and remainder of my said goods Chattells Debts Effects and other personalty whatsoever after payment of the respective legacys herein by me before bequeathed I give devise and bequeath the same unto my said Sons THOMAS HOOLEY and JOHN HOOLEY and my said daughter REBECCA HOOLEY equally amongst them share and share alike AND I do hereby nominate and appoint my said two Sons THOMAS HOOLEY and JOHN HOOLEY and my said Daughter REBECCA HOOLEY Executors of this my last will and Testament in confidence that they will execute faithfully the Trusts hereby reposed in them AND I do hereby revoak all former and other Will and Wills by me at any time heretofore made AND IN TESTIMONY that 1882 Aug 19 - North Wales Chronicle - Churches & Churchmen - In Macclesfield Church, on Sunday afternoon, as the vicar was about to pronounce the benediction after the children's floral service, a brass chandelier, weighing about 5cwt., suspended from the roof in the centre aisle, fell to the floor. No one was hurt. The chandelier was presented to the church in 1744 by Mr Hulley, who was then Mayor of Macclesfield.
