This is the last Will and Testament of me JASPER HOOLEY of Macclesfield Forest in
the County of Chester Farmer First I direct all my just debts Funeral Expences and the
Charges of the Probate of this my Will to be paid with all convenient speed after my
decease out of my Personal Estate and in case that shall be insufficient then I charge
my freehold Estate or Leasehold for lives with the payment of the deficiency And
subject thereto I give and devise my Estate in Macclesfield Forest aforesaid called
Twelve Ashes which I hold for lives under the Earl of Derby unto my Nephew JAMES
HOOLEY (Son of JONATHAN HOOLEY) of Macclesfield Labourer TO HOLD to him my
said Nephew JAMES HOOLEY his heirs and assigns for and during all my Estate and
Interest therein so that my said Nephew his heirs and assigns shall not convey away
or dispose of the said Estate to any person or persons other than to some or one of
the children of my Sister MARY HALL if they or any of them be disposed to purchase
the same And subject as aforesaid I give and devise my other Estate in Macclesfield
Forest aforesaid called Forest Side now in the occupation of JOSEPH TRUEMAN and
also which I hold under the Earl of Derby for my own life and the life of my Wife unto
my Dear Wife HANNAH HOOLEY TO HOLD to her my said wife and her heirs and
assigns for and during all my Estate and Interest therein I give and bequeath unto my
said wife and her heirs and assigns for and during the term of her natural life the
Interest of the Sum of Two Hundred Pounds owing to me by the Executors of the late
JOHN PLANT of Lawton Green and secured by Bond and also the whole or such part
of my household goods and Furniture as my Trustee or Trustees for the time being
shall think proper during the Term of her natural life AND subject as hereinbefore
mentioned I give and devise all those my leasehold Messuages or Dwellinghouses
with the Land Outbuildings and Appurtenances thereunto belonging situate in or
being near to Crompton Road in Macclesfield in the said County of Chester unto
SAMUEL HALL of Tytherington in the said County Yeoman his Executors
Administrators and assigns for and during all such Remainder of a certain Term of
Nine Hundred and Ninety Nine Years as I shall have therein at the Time of my
decease subject to the Lease thereof and the rent thereby reserved To the Uses and
Upon the Trusts hereinafter declared concerning the same and I give and bequeath
unto the said SAMUEL HALL his Executors Administrators and assigns the said
principal Sum of Two hundred pounds and the said Security for the same Upon the
Trusts hereinafter declared AND I do hereby declare the said Leasehold
Heredictaments and premises situate in or near Crompton Road aforesaid with the
Appurtenances to the same belonging and the said principal Sum of Two hundred
pounds are so devised and bequeathed to my said Trustee and Trustees for the Time
being as aforesaid Upon the Trusts and to and for the several uses hereinafter
mentioned expressed and declared of and concerning the same (that is to say)
UPON TRUST that my said Trustee or Trustees for the time being do and shall with
all convenient speed after my Decease absolutely sell and dispose of my last
mentioned Heredictaments and premises by public Auction or private Contract for the
best price that can be fairly obtained for the same AND AS FOR AND CONCERNING
the money thereby arising and the said principal Sum of Two hundred pounds after
the decease of my said Wife and after deducting all incidental Expences attending
the said Sale and of preparing an Abstract of the Title of the said Heredictaments
hereby made Saleable UPON TRUST that my said Trustee and Trustees for the time
being do and shall divide and pay the same unto between and amongst the several
persons hereinafter named and described, that is to say, To WILLIAM LEATHER OF
Sutton Blacksmith and THOMAS LEATHER of the same place Labourer Sons of my
Sister JUDITH LEATHER deceased To WILLIAM HALL SAMUEL HALL and MARY
BIRCHINALL Sons and Daughters of my late Sister MARY HALL deceased To
ISABELLA PICKFORD the Wife of MATTHEW PICKFORD and Daughter of my late
Brother JONATHAN HOOLEY deceased To JOSEPH TRUEMAN HANNAH the Wife
of WILLIAM WHITELEGG Butcher MARY TRUEMAN TAMAR the Wife of
GASKELL Labourer and JUDITH the Wife of WILLIAM TAYLOR Farmer Son and
Daughters of my late Sister JANE HOOLEY To JOHN NIXON Son of my Late Sister
HANNAH NIXON To the Children of BETTY CRAPUR deceased and the Children of
JOHN TRUEMAN deceased my late Niece and Nephew AND I do direct that each of
them the said WILLIAM LATHER THOMAS LEATHER WILLIAM HALL SAMUEL
HALL JONATHAN HALL MARY BIRCHINALL ISABELLA PICKFORD JOSEPH
TRUEMAN HANNAH WHITELEGG MARY TRUEMAN TAMAR GASKELL JUDITH
TAYLOR and JOHN NIXON shall take equal shares in the said Division AND that the
Children of the said JOHN TRUEMAN deceased shall also take amongst them in
equal proportions one other of the said shares or in the aid Division AND it is my Will
and Mind and I do declare that if any of the said Legatees shall depart this life before
becoming entitled to their respective Legacies under this my Will (which I direct to be
paid to such of them as shall be of Age with all convenient speed after the
Completion of the said Sales as to the money thereby arising and as to the said sum
of Two hundred Pounds after the decease of my said Wife and to such of them as
shall be under Age when and as they shall severally attain the Age of Twenty one
years) and shall leave lawful Issue such Issue shall have and take the part or Share
which their or his or her parent would have had and taken if living ands shall be paid
to such Issue when they shall have attained the Age of Twenty one years respectively
but if any of the said Legatees shall so depart this life before becoming entitled to
their said Legatees and shall not leave lawful Issue or whose Issue shall die under
the Age of Twenty one years then and in such case I direct that the part or Share of
the said Legatees so dying as last mentioned shall be paid to the survivors of the
said Legatees and the Issue of any of them so dying as aforesaid who may live to
attain the Age of Twenty one years in such shares and proportions as shall be
agreeable to the Rule and Law of Consanguinity in such Cases AND I also direct
and declare that the Receipt of any Money to arise by Sale of the said
Heredictaments hereby made saleable or any part thereof it shall and may be lawful
to and for said Trustee or Trustees for the time being to sign and give receipts for
the money for which any of the said Heredictaments shall be sold and that to the
person or persons paying such money such receipt shall be sufficient discharge for
the money for which the same receipts respectively shall be given or for so much of
such money as by such receipt shall be acknowledged to be received and that the
person or persons paying such money and taking such receipt or receipts for ther
same money respectively as aforesaid shall not afterwards be answerable or
Accountable for the loss Misapplication or Nonapplication or be in any wise obliged
to see to the Application of such Money or any part thereof respectively AND I give
and bequeath unto the said SAMUEL HALL as his own property absolutely all the
rest residue and remainder of my personal Estate and Effects not hereinbefore
bequeathed AND I nominate constitute and appoint the said SAMUEL HALL sole
Executor of this my Will and I do declare that it shall and may be lawful to and for
him my said Trustee and Executor to reimburse and satisfy himself from and out of
the Rents Monies Effects and premises which may come to his hands by virtue of
this my Will all such Costs Charges Expences and Trouble as he may bear pay
sustain expend or be put unto in or about the Execution of the Trusts an purposes of
this my Will and that he shall not be answerable for any more Rents Monies or Effects
than he shall actually receive under this my Will nor for any loss or deficiency in or to
the same Rents Monies or Effects or to the said hereby devises and bequeathed
Heredictaments Effects and premises either from Insolvent Tenants bad or insufficient
Securities or otherwise howsoever unless such loss or deficiency shall happen or be
occasioned by or through his wilful neglect or Default neither shall any Trustee or
Executor for the time being be answerable or Accountable for the Acts Receipts
Neglects or defaults of any other but each of them for himself and his own Acts
Receipts Neglects or defaults only and hereby revoking all former Wills by me at any
time heretofore made I publish and declare this to be my last Will and Testament IN
WITNESS whereof I the said JASPER HOOLEY the Testator have to the first three
Sheets of this my Will which is contained in four sheets of paper written on one side
only set my hand and to this fourth and last Sheet thereof my hand and Seal this

James Hooley no. 36 I have found a burial entry for St. Pauls Church Macclesfield 17th
March 1857 aged 58 or so I thought but I checked the entry again this week at Chester
and his age is badly written so I asked the Archivist his opinion and we have revised his age as 68 years. He was unmarried.

2010 03 Dec - Note from Alan Hulley I have new info on a James Hooley who was buried at St.Pauls Church Macclesfield
Mar 15th 1857 aged 58 as I thought, but I checked again at Chester and got two of the
staff to look at the entry and we decided that he was aged 68. Now I thought he maybe
from Macc. Forest born circa1789/90 so I obtained his death certificate. It confirmed
his last address as Turnock Street and he died Mar 11th, death registered Apl 4th by J. Roscoe Knutsford Coroner. Died of Natural Decay. His age on the certificate was
72 years and his occupation Cowdoctor, so now he must have been born 1784/5.

agreeable to the Rule and Law of Consanguinity in such Cases AND I also direct
and declare that the Receipt of any Money to arise by Sale of the said
Heredictaments hereby made saleable or any part thereof it shall and may be lawful
to and for said Trustee or Trustees for the time being to sign and give receipts for
the money for which any of the said Heredictaments shall be sold and that to the
person or persons paying such money such receipt shall be sufficient discharge for
the money for which the same receipts respectively shall be given or for so much of
such money as by such receipt shall be acknowledged to be received and that the
person or persons paying such money and taking such receipt or receipts for ther
same money respectively as aforesaid shall not afterwards be answerable or
Accountable for the loss Misapplication or Nonapplication or be in any wise obliged
to see to the Application of such Money or any part thereof respectively AND I give
and bequeath unto the said SAMUEL HALL as his own property absolutely all the
rest residue and remainder of my personal Estate and Effects not hereinbefore
bequeathed AND I nominate constitute and appoint the said SAMUEL HALL sole
Executor of this my Will and I do declare that it shall and may be lawful to and for
him my said Trustee and Executor to reimburse and satisfy himself from and out of
the Rents Monies Effects and premises which may come to his hands by virtue of
this my Will all such Costs Charges Expences and Trouble as he may bear pay
sustain expend or be put unto in or about the Execution of the Trusts an purposes of
this my Will and that he shall not be answerable for any more Rents Monies or Effects
than he shall actually receive under this my Will nor for any loss or deficiency in or to
the same Rents Monies or Effects or to the said hereby devises and bequeathed
Heredictaments Effects and premises either from Insolvent Tenants bad or insufficient
Securities or otherwise howsoever unless such loss or deficiency shall happen or be
occasioned by or through his wilful neglect or Default neither shall any Trustee or
Executor for the time being be answerable or Accountable for the Acts Receipts
Neglects or defaults of any other but each of them for himself and his own Acts
Receipts Neglects or defaults only and hereby revoking all former Wills by me at any
time heretofore made I publish and declare this to be my last Will and Testament IN
WITNESS whereof I the said JASPER HOOLEY the Testator have to the first three
Sheets of this my Will which is contained in four sheets of paper written on one side
only set my hand and to this fourth and last Sheet thereof my hand and Seal this
thirteenth day of October in the year of our Lord One thousand hundred and twenty
