This is the Last Will and Testament of me THOMAS HULLEY of Macclesfield in the
County of Chester Shopkeeper and Coal Dealer made and Published this Fifteenth day
of September One thousand Eight Hundred and forty three in manner following that is
to say First I will order and direct that all my Just debts Funeral expenses and the
Expences of Proving this my Will shall be paid and discharged by my Executors
hereinafter named as soon as conveniently can be after my decease And as to for
and concerning all and singular my Property whether real or Personal or of whatever
other nature or kind the same may be which I shall be seized or possessed of or over
which I shall have a disposing power at the time of my decease I give devise and
bequeath the same respectively and every part thereof unto my brother JESPER
HULLEY of Hurdsfield Coal Dealer and WILLIAM BOWYER of Macclesfield aforesaid
Grocer, their heirs Executors and Administrators or the survivor or survivors of them
According to the nature of the said Estates and Properties respectively Upon the
several Trusts and to answer for the several uses ends intents and purposes
hereinafter declared of and concerning the same that is to say Upon trust that they the
JESPER HULLEY and WILLIAM BOWYER and the survivor or survivors of them and
heirs Executors and Administrators of such survivors or survivor do and shall permit my
loving Wife ELIZABETH HULLEY to have the full and free use and enjoyment of All my
Household Furniture Stock in Trade Shop Fixtures Plate Linen and China together the
House I now live in with Coal Yard and other Appurtenances thereto belonging during
the term of her Natural life And also shall allow my said Wife to receive the Rents
issues and profits of all my Freehold Property situate in Derby Street and now in
occupation of myself and others, for and during the term of her natural life And from
and immediately after her decease It is my Will and mind they my said Trustees their
Heirs Executors and Administrators or the survivor or survivors of them do and shall
sell and dispose of all my Household Goods Stock in Trade and other effects of
whatever nature the same may be And to collect all Book debts and Monies out at
Interest or otherwise And pay and apply the same unto and amongst my children
JESPER HULLEY, MARTHA PARKINSON, ELIZABETH HULLEY, and ESTHER
HULLEY share and share alike as tenants in common and not as joint Tenants And
also shall get or cause all my Property situate and lying in a certain street called or
known by the name of Derby Street In Macclesfield aforesaid to be appraised and
valued and then to offer the same unto my said Children if they think proper to take
them in manner following that is to say to my son JESPER HULLEY the House that I
now live in with the Coal Yard and appurtenances thereunto belonging he paying to
the said Trustees the overplus amount of the value thereof if more than the other
shares is valued at And allowing to the two Houses adjoining a Right of Road four feet
wide to the back of the Premises and then to offer to my daughter MARTHA
PARKINSON the House now occupied JOSEPH COX and adjoining to the one I now
occupy taking it according to its value And also to my daughter ELIZABETH HULLEY
the house now in the occupation of JAMES WALTON and adjoining to the house
occupied by JOSEPH COX according to the value thereof And also to my daughter
ESTHER HULLEY the houses situate and lying on the south side of Derby Street and
now occupied by THOMAS PEACOCK SAMUEL MALKIN and JOEL DEAN according
to the value thereof And also they my said Trustees their Heirs Executors and
Administrators or the survivor or survivors of them do and shall offer to my said Children
to take the houses in manner aforesaid according to the value thereof so that each
Child may have equal share and share alike as Tenants in Common and not as joint
Tenants And I do hereby declare that if any of my said Children shall refuse to take the
house, houses, or share in manner aforesaid Then they may my said Trustees their
Heirs Executors and Administrators or the survivor or survivors of them do and shall
dispose of the same by Public Auction or private contract as he or they may think fit and
best and for the most money that can be had or obtained for the same and to divide
the money arising from such sale or sales amongst my Children share and share alike
as tenants in common and not as joint Tenants so that my Children shall receive an
equal share of both my real and Personal Property And also that my said Trustees
their Heirs Executors and Administrators or the survivor or survivors of them Do and
shall make execute and perfect all necessary and proper deed, deeds, writings,
conveyances and Assurances for the purpose of investing the same in any purchaser
or purchasers thereof or in such person or persons and for such uses, intents and
purposes as he or they shall direct or appoint And I do hereby direct the receipt or
receipts of my said Trustees or the acting Trustee of this my Will for the time being
shall be a good valid and sufficient acquittance and discharge or acquittances and
discharges to the person or persons respectively who shall become the purchaser or
purchasers of all or any part of my Estate hereby directed to be sold for all or any part of
the money to be by them or him paid for the same or so much thereof as in such
receipt or receipts respectively mentioned who shall become such purchaser or
purchasers shall not after paying his her or their said purchase money to my said
Trustee or Trustees for the time being or to his her or their order be answerable or
accountable for the misapplication or non application of the same or any Part thereof
And further it is my Will and mind And I do hereby direct my said Trustees that if any of
my said Children die before receiving his or her share leaving lawful issue then such
issue of any of my said Children to take such part or share as their Parent would have
taken if living, and so as no person or persons may or shall take as or under the
description of issue until his her or their Parent or respective Parent shall have
departed this life And in case there shall be but one such child or the issue of only
one living at the time aforesaid then to such one only Child the Parent’s share of such
Child to be Paid And it is my Will and meaning And I do hereby declare that my said
Trustees or my Executors hereinafter named or any or either of them shall not be liable
to answer or make good any loss or losses that shall or may happen in transacting any
money affairs afterwards or in placing out monies according to the directions in this my
Will or otherwise relating to or concerning the execution of the Trusts mentioned
herein unless the same shall appear to happen by or through their, or nay, or either of
their wilful neglect or default nor shall either of my said Trustees be answerable or
accountable for the Acts Deeds Receipts or disbursements of the other of them but
each of them shall be answerable only for his separate Acts Deeds Receipts and
disbursements And I do hereby direct that my said Trustees and Executors shall and
may Pay and reimburse themselves and himself out of the Estate and effects all
reasonable and necessary Cost, Charges and Expences whatever that they or any or
either of them shall or may bar pay or sustain or be put unto or about the execution of
this my Will or the Trusts hereby in them reposed And Lastly I do hereby nominate
constitute and Appoint the said JESPER HULLEY and WILLIAM BOWYER and my
Wife ELIZABETH HULLEY Executors and Executrix of this my Will And I do hereby
revoke all or other Wills at any time heretofore made and do declare this to be my last
Will and Testament In Witness whereof I have to this my last Will contained in three
Sheets of paper set my hand to each and every sheet the day and Year aforesaid.

1848 Mar 11 - Staffordshire Advertiser - CROWN COURT - FRIDAY JOSEPH HULLY, JOHN BAKER, JOHN BETHELL,
and JOHN WILLIAMS, were indicted for stealing a loaf of bread, the property of John Fellows, of
Cheadle, and sentenced to two calendar months’ hard labour and to be well whipped. Joseph Hully and
John Williams were also ordered to be whipped a second time at the expiration of the first month’s
imprisonment upon a second indictment.

This is the last will and Testament of me Josiah Hulley of Macclesfield in the County of
Chester Confectioner made this twenty eight day of January xux in the year of our Lord
One Thousand eight hundred and fifty. First I will order and direct that all my just debts
and funeral and testamentary expences shall be paid and discharged by my
Executors and Executrix hereinafter named as soon as conveniently may be after my
decease out of my ready money and money that may be owing to me if sufficient if not
then I charge my freehold and leasehold hereditaments and premises with the
payment of the deficiency I give and bequeath unto my Daughter ESTHER HULLEY All
my Household Goods and Furniture of every description (except one Bed and
Bedding thereto which I give to my Daughter SARAH HATTON) I also give and
bequeath unto my said Daughter ESTHER HULLEY all my Stock in Trade as a
Confectioner And all Articles implements and things appertaining thereof I give devise
and bequeath unto JAMES BROUGH of Macclesfield Forest in the said County of
Chester Farmer and my Nephew JONATHAN HULLEY son of my Brother JASPER
HULLEY All my Freehold and Leasehold Messuages Cottages or Dwellinghouses
lands hereditaments and premises situate in Macclesfield aforesaid or elsewhere To
Hold to them the said JAMES BROUGH and JONATHAN HULLEY their heirs
Executors and administrators Upon Trust to set and let the same in such manner as
they or the survivor of them his Heirs Executors or Administrators shall think proper
and by with and out of the rents arising therefrom do and shall first pay all such of my
debts funeral and testamentary expences as my Ready money and money owing to
me shall fall short of paying and after payment and satisfaction thereof then do and
shall out of such rents pay to my late wife’s sister ANN NEWTON now residing at
Oldham in Lancashire the weekly sum of four shillings to be paid to her monthly
during her life and then do and shall out of such Rents pay to each of my said
Daughters SARAH and ESTHER the weekly sum of eight shillings during their
respective natural lives [interlined - for their separate use and benefit free from Marital
control] and then do and shall put and invest the surplus of such rents in the
Macclesfield Savings Bank to accumulate for the space of six Calendar months and at
the end of the first and every succeeding six Calendar months do and shall withdraw
such money from the Savings Bank and divide the same equally between my said two
Daughters during their respective lives as aforesaid after paying Ground Rent Repairs
Leys and Taxes and other outgoings in respect of my said freehold and leasehold
hereditaments and premises and in case of the death of either of my said Daughters
leaving lawful issue then do and shall pay such deceased daughters weekly sum of
Eight shillings and share of surplus rents unto such issue equally if more than one
during the life of my surviving daughter and in case either of my said Daughters shall
happen to die without leaving lawful issue or leaving such issue and all such issue
shall happen to die during the life of my surviving Daughter without leaving lawful issue
then do and shall pay such weekly sum of eight shillings and share of surplus Rents to
which such deceased Daughter or her issue would have been entitled unto my
surviving Daughter during her life And on the death of the survivor of my said daughter
then do and shall pay to the lawful issue of each of my said Daughters the said Weekly
sum Eight shillings and also the share of surplus rents after the deductions aforesaid
to which their parent would have been entitled to if living for and during the term of
Fourteen years after the death of the survivor of them my said Daughters and if all the
lawful issue of either of my said Daughters shall happen to die before the expiration
of the said term without leaving lawful issue then top pay the share of Rents to which
such issue dying as last aforesaid would have been entitled to unto the lawful issue of
my other Daughter during the said term of Fourteen years And on the expiration of the
said term of Fourteen years in case there shall be issue living of my said Daughters or
either of them Then upon Trust that they my said Trustees or the survivor of them or
the heirs executors or administrators of such survivor do and shall sell my Freehold
and Leasehold Messuages or dwellinghouses Hereditaments and premises either
by public or private sale and under and subject to such conditions as they or he shall
think necessary with power to buy in and resell the same without being liable for any
loss to arise thereby And the money arising from such sale after defraying all
incidental expences attending such sale do and shall pay and divide unto and
among such of the lawful Children of my Daughters or Daughter as shall be then
living and the issue of such of them as shall be then dead leaving lawful issue
equally share and share alike taking according to the stocks and not according to
the number of individuals the share or shares of such of them as shall have attained
the age of Twenty one years to be paid to him her or them immediately and the
share or shares of such of them as shall not have attained the age of Twenty one
years to be paid to them respectively on attaining that age the interest and so much
of the principal of their respective shares at the discretion of my said trustees to be in
the man time applied in their respective maintenance clothing and education or in
placing them out apprentice or in business or otherwise preferring them in the world
But in case both of my said Daughters shall to die without leaving lawful issue or if
either or both of them my said Daughters shall leave lawful issue and all such issue
shall happen to die before the expiration of the said term of Fourteen years without
leaving lawful issue then in either of the said cases I give devise and bequeath my
said freehold Hereditaments and premises unto my said Nephew JONATHAN
HULLEY his heirs and assigns forever And then I will order and direct that my said
Trustees or the survivor of them or his heirs or assigns to sell my Leasehold
Messuages or dwellinghouses and premises in manner aforesaid and divide the
money arising therefrom after defraying all incidental expences and the
Accumulations from surplus Rents among the Children of my Brothers THOMAS
JOHN and ALEXANDER (except JASPER the son of my late Brother THOMAS and
his issue) that shall be then living and the lawful issue of such of their Children as
shall be then dead leaving lawful issue equally share and share alike such issue
taking only their deceased parents share equally among them if more than one
Provided always and it is my will and mind and I do hereby will order and declare that
JASPER HULLEY and ESTHER HULLEY the two illegitimate Children of my said
Daughter SARAH HATTON by JAMES HATTON her present Husband and their lawful
issue shall have received and be entitled to an equal share as well as original as
accruing by survivorship with the other Children of my said Daughter and their issue
of and in the same trust monies and rents and that the said two illegitimate Children
JASPER HULLEY and ESTHER HULLEY and their lawful issue shall be treated in all
respects as lawful issue of my said Daughter SARAH and I hereby direct and
empower my said Trustees or the survivor of them his Executors or Administrators to
pay such share or shares of the said trust monies and rents to the said JASPER
HULLEY and ESTHER HULLEY and their lawful issue accordingly Any thing
hereinbefore contained to the Contrary thereof in anywise not withstanding And on
the death of the said ANN NEWTON I direct that the said weekly sum of Four
shillings shall be applied in the like manner as I have directed the surplus rents of
my Freehold and Leasehold Hereditaments and premises to be applied And for
perfecting such sale or sales of my Freehold and Leasehold Hereditaments and
premises respectively directed to be sold as aforesaid and other the trusts and
purposes of this my Will I do hereby declare that the Receipt or Receipts of my said
Trustees or the survivor of them or the Heirs Executors or Administrators of such
survivor for the money received upon such sale or for any rents or other monies they
or any of them shall or may at any time receive under or by virtue of this my Will shall
be a sufficient discharge to any purchaser or purchasers or any other person or
persons paying any such monies for the amount in such Receipt or Receipts
acknowledged to be received and that such purchaser or purchasers tenant or
tenants or other person or persons paying such money shall not afterwards be
answerable or accountable for the misapplication or nonapplication of such
purchase money or other monies or any part thereof or be obliged to see to the
application thereof or of any part thereof And I give and devise all Estates vested in
me as Trustee or Mortgagee unto my said Trustees their heirs and assigns upon the
trusts and equities affecting the same And I do hereby nominate constitute and
appoint the said JAMES BROUGH and my said Nephew JONATHAN HULLEY
executors and my said Daughter ESTHER HULLEY Executrix of this my Will And I
absolve the Trustees and Trustee for the time being of this my Will from
responsibility for the receipts and defaults of each other and for involuntary losses
and also authorize such Trustees and Trustee to reclaim and allow to each other all
expences incurred in or about the execution of this my Will And Revoking all former
and other Wills be me made I make and declare this to be my last Will and
Testament In Witness whereof I the said Testator JOSIAH HULLEY have hereunto

JAMES BROUGH ON OF THE Executors in this Will named was sworn in common
form (power being reserved to JONATHAN HULLEY and ESTHER HULLEY the other
