25. James Hulley

Note: the ancestry of James Hulley has been difficult to trace but the major clue was the discovery of a
baptism of James Ridley Hulley to his son Thomas at Frodsham in 1818. Ridley was the surname of
James Hulley's wife Betty so it was a reasonable assumption that Thomas had named his son after his
grandmother.
It appears that he started his married life in the Prestbury /Macclesfield area, had 2 children there before
moving to Frodsham c1780 where he had a further 2 children. He, his wife and first child Mary were
buried at St Peter's church Prestbury.

Mr Hulley, in Macclesfield, Cheshire in whose possession the Organ now is.

1780 Sep 12 - Adams’s Weekly Courant - To be sold by Auction, at the King’s Arms in Macclesfield, on Thursday the
28th Day of September, at three in the Afternoon, subject to Condition: a large and substantial Dwelling-
house, situate in Chester Gate, near the Market Cross, in Macclesfield aforesaid, late the Property of Mr
Ridley, and now in the possession of Mr Hulley, Surgeon; containing a Shop, two Parlours and Kitchen
on the Ground Floor, with a large Dining Room, and seven good Bed-chambers, besides the Rooms in
the Attick Story, with a Stable, convenient out Offices, two large Cellars, a Pew in the Old Church, and a
Moss Room on the Din’s Moss. The Premises are extremely well situated for Business, and in thorough
good Repair. And to be Sold by Auction on the ensuring Day: All the Household Furniture, late of the said
Mr Ridley, without Reserve. For Particulars apply to the said Mr Hulley, who hath to dispose of, a large

c1784 - son Thomas Boydell born - Thomas Boydell Hulley married in 1802 so his year of birth has been com-
-puted to be no later than 1784 ie 18 years before his marriage. No record of birth or baptism has been
found.

would have bin so obliging to have settled Mr. Lee's acct., at the same time hope you will not take it ill in
me writing upon that head, but as I have some payments to make, was the only reason, from Sr. Yr. Most

PS the acct. sent Oct 10th 1782 is £9.15s. 0d.
I have laid in a quantity of exceeding fine old Jamaica Rum, and Coniac Brandy, if Mr. Lee should be in

Frodsham the 17th day of May One Thousand Seven hundred and Ninety Nine

I James Hulley Surgeon Apothecary and Man-Midwife do hereby Certify this to be my last Will and
Testament therefore Will and Bequeath all my Property Consisting of Book Debts not exceeding £50
Pounds and Household Furniture & Shop two Horses and one Cow which I request my son Thomas
Boydell Hulley to have lawfully valued the half of which I give to my Daughter Betsy and the remaining
part to my said son Thomas B. Hulley and I do hereby appoint him to execute these my requests as
he shall answer to God at the great Day of Judgement. The provision made for my Daughter being so
small on account of Misfortunes in Life hope my son Thomas as an Affectionate Brother will take this into
Consideration so that she shall not know the want of either Father or Mother - under this pleasing
Consolation I shall Die happy whenever it shall please the Lord to call my Soul.

Day of May One Thousand Seven Hundred and Ninety Nine.

1799 31 May - Chester Chronicle - DIED - Wednesday last at Frodsham, most deservedly regretted, after a lingering
illness, which he bore without a murmur of discontent or an ejaculation of impatience, Mr. James Hulley,
surgeon and apothecary. In him were united many virtues; his attachments to his friends were uniform
and sincere; to his children he was a tender and an affectionate parent; to the poor he was humane and
charitable, and of society he was an upright and valuable member.

On which Day Appeared Personally William Caldwell of the Strand in the County of Middlesex
Gentleman who being sworn on the holy Evangelist to depose the truth made oath as follows that he
knew and was well acquainted with James Hulley late of Frodsham in the County of Chester for some
time prior and until his Death which happened in or about the Year One thousand seven hundred and
Ninety nine and during such acquaintance with him the deceased has often seen him write and
subscribe his Name to Writings and is thereby become well acquainted with his manner and character
of Handwriting & Subscription and having now carefully viewed and Perused the Paper Writing hereto
annexed purporting to be the Last Will and Testament of the said deceased beginning thus “Frodsham
the 17th day “of May One thousand seven hundred & “ninety nine” and ending thus “ Witness “my hand
this seventeenth Day of May “One thousand seven hundred and ninety “Nine” and thus subscribed “Js.
Hulley” This deponent doth verily and in his Conscience believe that the whole body series and contents
of the said Will together with the Names “Js. Hulley” set and subscribed at the foot or bottom thereof to
be all of the proper handwriting and subscription of the said deceased.

are holden and firmly bound unto the Right Reverend Father in
God William by Divine permission, Lord
Bishop of Chester in the Sum of one
hundred Pounds, of good and lawful Money of
Great Britain, to be paid unto the said Right Reverend father
his lawful Attorney, Executors, Administrators or Assignes, To
which payment well and truly to be made, we bind our selves and
each of us Severally for and in the whole,
our Heirs Executors and Administrators, and the Heirs Exe-
cutors and Administrators of each of us firmly
by these Presents, Sealed with our Seals and dated the fifth

year of the Reign of our Sovereign Lord George,

THE Condition of this Obligation is such; That if The above-

Ridley now licenced to be married together be neither
of Consanguinity or Affinity the one to the other, within the De-
grees prohibited for Marriage: If also there be no Let or Impediment,
by Reason of any Precontract, entered into, before the Twenty-Fifth
Day of March, One Thousand, Seven Hundred, and Fifty Four, or
any other lawful Cause whatsoever, but that they may be lawfully
married together, both by the Laws of GOD, and this Land:
Moreover, If the Persons, whose Contract is required by Law in this
behalf, be thereunto agreeing: And lastly If the said Marriage be
done and solemnized in such Manner, as in the Licence to them grant-
ed is limited: Then this Obligation to be void or else to remain in
full Force and Vertue.

WILL of JASPER HULLEY of Hurdsfield 1817

This is the Last Will and Testament of me JASPER HULLEY of Hurdsfield in the County
of Chester Collier made and Published this Fifth day of April in the year of our Lord One
thousand eight hundred and seventeen. First I will and direct that all my just Debts
Funeral Expenses and the Charges of Proving this my Will shall be paid out of the
Property hereinafter bequeathed and subject thereto. I Give. Devise and Bequeath
unto sons THOMAS HULLEY and JASPER HULLEY there Executors Administrators
and Assigns all my Monies Goods Chattels Estate and Effects of ant nature or kind
soever and wheresoever and also all my Leases and Shares in Leases for Years,
Upon certain Coal Mines Upon Trust for them the said THOMAS HULLEY and JASPER
HULLEY and the Survivors of them their Executors Administrators and Assigns to
permit and suffer my dear wife HANNAH to have the sole use and enjoyment of my
Household Goods and Furniture for and during the term of her natural Life but to
prevent and not suffer her to embezzle or waste the same And also upon Trust that my
said Trustees shall and do see after the management of the different shares in my said
Coal Mines that I now have or may hereafter have Possession of according to the best
of their skill and power and the Monies arising from the Produce of the Coals thereof
that way from time to time shall be gotten or disposed of I direct my said Trustees to
pay so much thereof as they shall adjudge sufficient for the support and maintenance
of my said Wife to her for and during the term of her natural Life and the Overplies (if
any such there shall be) I direct my said Trustees to retain and keep in their hands until
the decease of my said Wife and then to be disposed of as hereinafter mentioned
Provided Always and I do hereby direct and declare that if my said Trustees shall not
think the Produce of the Coal Mines sufficient for the maintenance of my said Wife then
and in such case I direct them my said Trustees to sell and assign over all and singular
my shares in the said Coal Mines if the Leases thereof shall so long continue by Public
Auction or Private Contract at one or separate time or times for the most money that
can be reasonably gotten for the same and the monies arising thereof I direct my said
Trustees to place the same out at Interest and the Interest arising therefrom I direct may
said Trustees to pay and apply the same in and towards the maintenance of my said
Wife for the term of her Natural Life and if my said Trustees shall not think the same
sufficient for that purpose I direct them to advance and pay from time to time out of the
Principal money such deficiency And from after the decease of my said Wife I direct
my said Trustees as soon as conventionally may be make sale and dispose of all and
singular my said Personal Estate and Effects whatsoever of what nature or kind soever
and also of all my shares in the said Coal Mines if the terms therein shall so long
continue and in case my said Trustees shall not have them disposed of may aid Coal
Mines for the purpose aforesaid and in case the monies arising from my said Cola
Mines and Personal Estate shall have been deemed more than sufficient to support
my said Wife then I direct such overplies of such trust monies together with the
Produce of such sale or sales to be equally divided between and amongst my Five
Children namely the said THOMAS, the said JASPER, JOHN, ALEXANDER, and
JOSIAH equally share and share alike any if any one or more of my said Children
Shall happen to die before such division be made I direct the share or shares of him
or them so dying to be paid to his Child or Children and in default of such Child or
Children then the shares of him or them so dying to be equally divided between and
amongst my surviving Children And I direct that the receipt or receipts of my said
Trustees shall be sufficient discharge or discharges to the Purchase or Purchases of
my said Leasehold Coal Mines And also I direct that my said Trustees shall from time
to time be at Liberty to deduct and retain out of the monies arising from this my Will
that they shall or may receive any reasonable expenses that they may be put into by
virtue of the trusts of this my Will And Lastly I do hereby nominate constitute and
appoint the said THOMAS HULLEY and JASPER HULLEY Executors of this my Will
and hereby revoking and making void all former and other Will or Wills by me at any
time heretofore made do declare this to be my last Will and Testament In Witness
whereof I have hereunto set my hand and seal the day and year aforesaid.
