Sarah Barnes

Note - although the FT compiled by Ann Ball shows the James son of Jonathan Hooley (b 1745) and Betty nee Boyer to be the husband of Sarah Barnes, I believe this to be erroneous. The James Hooley son of Jonathan and Betty is a member of a family of Silk workers - his father was a Twister in 1770 and 1810 and his elder brother John was a Twister in 1813. Compare this occupation to that of James Hooley of Hurdsfield who married Sarah Barnes in 1796. He was a Collier, which is similar to that of his father John Hooley b 1724 who was a Coal Carrier in 1758-1763.

1822 06 Jul - WILL OF THOMAS HOOLEY OF HURDSFIELD This is the Last Will and Testament of me THOMAS HOOLEY of Hurdsfield in the County of Chester Collier made published this sixth day of July one thousand eight hundred and twenty two FIRST I Will and Direct all my just Debts Funeral Expences and the charge of proving this my Will to be paid and discharged by my Executors hereafter Named and Subject thereto I give and devise all those my six Leasehold Houses Situate in Hurdsfield aforesaid also all my Household Furniture that I may be possessed of at the time of my decease unto my two Friends JOHN BROOME of Hurdsfield farmer and JASPER HULLY of the same place Collier In Trust to sell and dispose of the same as soon as conveniently may be after my Decease and the Monies arising by such Sale or Sales I direct my said Trustees JOHN BROOME and JASPER HULLY to divide the same into two Shares between my Sons ABRAHAM HOOLEY and JOHN HOOLEY equally alike Nevertheless if my said Trustees shall think it most advantageous not to Sell my said Leasehold property but to retain the same in their hands and apply the Rents arising therefrom towards the payment and liquidation of my just Debts I give them hereby Liberty so to do provided they do not retain the Property more than two Years after my Decease for the aforesaid Purposes And if either of my said Sons shall happen to die before it is convenient for such division to be made of any of the said trust Monies I direct my said Trustees to pay the same to his or their respective Isue (if any such he or they shall have) shall share and share alike and if such Parent or Parents so Dying shall have but one such Child apiece them the share or shares of him or them so dying to go to such deceased Parents’ only Child ands if either of them shall die without Lawful Isue then the share or shares of him or them so dying to be given to the survivor of them And if it shall happen that both of them my said Sons shall die before such division as aforesaid I direct that the share or shares of him or them dying to go to the Isue of either of my said Sons And I direct and declare that the receipt or receipts of my said Trustees shall be sufficient discharge to the person or persons who shall purchase my said Leasehold property And I direct that my Trustees shall be at liberty to deduct and retain in their hands any reasonable Expences that they may be put into in the Execution of the trusts of this my Will And lastly I do hereby nominate constitute and appoint the said JOHN BROOME and JASPER HULLY Executors of this my Will, on Witness Whereof I have set my hand and Seal the day and Year first above written.

goods furniture plate linen and China for her absolute use and benefit I give and bequeath unto JAMES BARKER of Stockport in the said County Silk manufacturer his heir executors administrators and assigns ALL my Messuages lands tenements Heredictaments and premises whether freehold Copyhold or Leasehold in possession reversion remainder or expectancy whereof or wherein I am or any person or persons in trust for me is or are seized or interested or over which I have a disposing power (except such as are vested in me as trustee or Mortgagee) with their and every of their appurtenances And all the residue of my personal estate whatever and od what nature or kind soever TO HOLD the same unto and to the use of the said JAMES BARKER his heir executors administrators and assigns UPON TRUST receive the dividends interest and annual produce of the said Stocks funds or Securities and the rents issues and profits of the said messuages lands tenements Heredictaments and premises until the Sale thereof and from time to time to pay the same unto or permit the same to be received by my said daughter during the term of her natural life for her separate use from the control and debts of any husband with whom she may intermarry and so that during any coverture she may be under she shall have no power to alien or anticipate the growing payments of the said dividends interest and annual produce or any part thereof and immediately after the decease of my said daughter then as to as well the said trust moneys stocks funds and Securities as the yearly dividends interest or produce thenceforth arising therefrom IN TRUST for all the children of my said daughter if there shall be more than one to take in equal shares as tenants in Common for their respective use and benefit And in case any one or more of the said Children shall die under the age of twenty one without having been married then as to as well the Original share or shares of the said trust moneys stocks funds and Securities belonging to the child or children respectively may have become entitled under this present trust IN TRUST for the other or others of the said children if more than one to take in equal shares as aforesaid for his her or their absolute use and benefit or in case there shall be Originally only one child of my daughter as aforesaid Then in trust for such only child for his or her absolute use and benefit But in case there shall be no child of my said daughter or no such child who shall live to acquire an absolute vested interest under the trusts hereinafter contained Then in Trust for such person or persons for such intents and purposes and in such manner and form as my said daughter shall by any deed or by her last Will and Testament Appoint give or devise the same And in default of such appointment gift or devise IN TRUST for her her Executors Administrators and Assigns And I direct that after the decease of my said daughter my trustee or the trustees or trustee for the time being of this my Will may apply all or any part of the interest and dividends of the expectant portion or portions of any of the children of my said daughter whose portion or portions shall not be vested for his her or their maintenance or education And also advance all or any part of such expectant portion or portions of any of the said Children of my said daughter whose portion or portions shall not be vested for or towards his her or their advancement or benefit I give and devise unto the said JAMES BARKER his heirs and assigns All real Estate now vested in me as trustee or
